Ord. #1307 1 CITY OF TAMARAC, FLORIDA 2 ORDINANCE No. 0-87- 3 AN ORDINANCE AMENDING CHAPTER 9 OF THE CODE 4 OF ORDINANCES OF THE CITY OF TAMARAC PERTAIN- ING TO FINANCE; CREATING SUBSECTION 9-5 TO BE ENTITLED "COLLECTION OF INTEREST AND ADMINIS- TRATIVE FEES FOR OVERDUE ACCOUNTS AND ITEMS RETURNED FOR INSUFFICIENT FUNDS BY BANKS AND ` LENDING INSTITUTIONS"; PROVIDING THAT 7 WHENEVER A CHECK DRAFT OR OTHER INSTRUMENT FOR PAYMENT OF MONEY IS RETURNED AS A $ DISHONORED ITEM BY A BANK OR LENDING INSTITUTION THE CITY SHALL NOT ACCEPT PAYMENT 9 WITHOUT FIRST RECEIVING INTEREST AND THE APPROPRIATE FEES; PROVIDING FOR THE COLLEC- TION OF INTEREST ON OVERDUE ACCOUNTS; PROVIDING FOR CODIFICATIION; PROVIDING FOR 11 REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. 12 13 WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and 34 WHEREAS, the City Council of the City of Tamarac deter- mines that it is in the public interest to adopt the follow- ing Ordinance to offset the administrative costs suffered by all taxpayers as a result of the City administering overdue ,19 19 accounts and the processing of unfunded checks. F 20 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 21 22 SECTION 1: That Section 9-5 of the Code of Ordinances 23 of the City of Tamarac is hereby created to read as follows: 24 25 Section 9-5. COLLECTION OF INTEREST AND ADMINISTRATIVE FEES FOR OVERDUE ACCOUNTS AND ITEMS RETURNED FOR INSUFFICIENT FUNDS BY BANKS AND LENDING INSTITUTIONS. 27 (A) In the event that monies due to the city for 2$ 29 services rendered are not paid upon their due date, the city is heresy authorized to collect W w said delinquency and may charge ten percent 32 (10%) per annum interest, said interest to be prorated upon the day of payment. 33 34 35 Temp. Ord. #1307 1 2 3 4 r 7 8 9 10 11 12 13 14 i� :b 18 19 20 21 22 23 24 25 `_b 27 28 29 r+ 32 33 34 35 (E) In the event that a check, draft or other order for the payment of money is returned to the city unpaid, by a bank or lending institution, then the city shall not accept payment on said account without receiving interest in accordance with Subsection "A" of this section, reimbursement for all overdraft charges assessed to the city by the bank or lending institution, plus a $10.00 or 5% of the face value of the check or order, whichever is greater, up to a maximum of $25.00, administrative fee for the processing the unpaid check or order. SECTION 2: Specific authority is hereby granted to codify this Ordinance. SECTION 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
