AN ORDINANCE AMENDING CHAPTER 27 OF THE CODE
OF ORDINANCES OF THE CITY OF TAMARAC; PER-
TAINING TO UTILITIES; AMENDING SECTION 27-31
RELATING TO ADJUSTMENT OF BILLS; PROVIDING

13 WHEREAS, a public hearing has been. held pursuant to
Chapter 166, Florida Statutes; and

WHEREAS, the City Council of the City of Tamarac deter-
15
mines that, it is in the public interest to adopt the follow-
16
ing Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:

SECTION 1: Section 27-31 of the Code of Ordinances of
20 the City of Tamarac is hereby'amended to read as follows:
21 Sec. 27-31. Adjustment of bills.
22 (A) When a consumer has been overcharged or
23 undercharged as a result of incorrect application of the rate
24 schedule, incorrect reading of the meter, incorrect
25 connection of the meter, or other similar reasons, the amount
?6 may be credited or billed to the consumer, as the case may
27 be. Any credit to the consumer shall be calculated and
28 credited for a period not to exceed three (3) months.
'9 However, there shall be no time limitation with respect to
undercharges which can be established by the City.
31 (B) Should water consum tion of an unusually and
32 inexplicably large v fume be recorded by an accurate meter
33 for a customer whose account shows no prior history of such

customer knows of no reason for such hi h consumption, reduce

SLIDING SCALE POLICY
Consumption must be 300% of average

SECTION 2: Specific authority is hereby granted to
codify this Ordinance.
SECTION 3: All Ordinances or parts of Ordinance in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 4: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 5: This Ordinance shall become effective
immediately upon adoption and passage.

the customer's plumbing system, reduce the customer's bill
pursuant to the following schedule:
SLIDING SCALE POLICY

be. Any credit to the consumer shall be calculated and
credited for a period not to exceed three (3) months.
However, there shall be no time limitation with respect to
undercharges which can be established by the City.
(B) Should water consumption of an unusually and
inexplicably large -volume be recorded by an accurate meter
for a customer whose account shows no prior history of such
high water consumption, the City Manager or his designee may,
upon receipt of a sworn Affidavit from the customer, that the
customer knows of no reason for such high consumption and a

statement by a licensed 2lumber that there are no leaks in
the customer's plumbing system, reduce the customer's bill by
t one half (1/2) the amount by which the bill exceeds the
billing for the customer's average water consumption.
SECTION _2: Specific authority is hereby granted to
codify this Ordinance.
SECTION 3: All Ordinances or parts of Ordinance in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION _4: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
-SECTION This Ordinance shall become effective
immediately upon adoption and passage.
