Ord. #1320 T Rev. 4/23/87 Rev. 5/13/87 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-87- ,;2•_ AN ORDINANCE ESTABLISHING FIRE INSPECTION FEES FOR INSPECTIONS PERFORMED BY THE CITY OF TAMARAC FIRE INSPECTORS; PROVIDING FOR FEES FOR INSPECTIONS; PROVIDING FOR RATES; PROVID- ING FOR CRITERIA; PROVIDING FOR CODIFICATIION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Florida law provides that municipalities are authorized to charge fees established by ordinance to defer the costs of the services rendered by the municipality; and WHEREAS, plan review and inspection of new construction and annual fire inspections are an integral part of a compre- hensive safety program to ensure that certain fire safety features are installed and maintained in the buildings of this community; and WHEREAS, the South Florida Building Code requires annual inspections within the community; and WHEREAS, the City of Tamarac is charged with the respon- sibility of providing qualified fire inspectors to perform the required fire inspections; and WHEREAS, quantity of inspections and review relating to new construction and the increasing number of annual inspec- tions have necessitated in the increase in the number of inspectors and has increased the resources and time involved by the currently employed inspectors; and WHEREAS, the benefit derived from the fire inspections is passed directly to the entities whose structures are being inspected; and -1- Temp. Ord. #1320 Rev. 4/23/87 Rev. 5/13/87 1 2 3 4 6 7 8 9 10 11 12 i 13 14 15 16 7 M 19 20 21 22 23 24 I 25 '6 27 28 29 0 31 32 33 34 35 WHEREAS, the fire inspection fees for new construction and for annual inspections shall be utilized to offset the costs of administering the inspection and review process; and WHEREAS, the burden of fire inspection fees would be borne by those directly benefiting from the inspection and review; and WHEREAS, the City Council deems it to be in the best interest of the citizens of Tamarac to establish fees for inspections performed by City fire inspectors; and WHEREAS, a public hearing has been held pursuant to er Chapter 166, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac deter- mines that it is in the public interest to adopt the follow- ing Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the following schedule, rates and criteria are hereby established for fire inspections performed by City of Tamarac Fire inspectors: (A) NEW CONSTRUCTION A fee in the amount of $.05 per square foot shall be levied on all new construction in the City of Tamarac. This fee shall encompass plan review and necessary fire inspections required prior to the issuance of a Certificate of Occupancy. 1WM Temp. Fees for Commercial, Industrial Properties, and Public Assembly Buildings A. Minimum fee (up to 5,000 sq. ft.) $25.00 Fee per 1,000 sq. ft. over 5,000 sq. ft. 1.75 B. Additional fee for administering fire safety inspections and tests of the following systems: 1. Standpipe System $35.00 2. Sprinkler System 35.00 3. Fire Alarm System 35.00 4. Smoke Evacuation System 35.00 C. Re -inspection fee 1. First re -inspection - no charge 2. Second re -inspection fee and each subsequent re -inspection shall be 25% of the initial inspection fee. 2. Fee for Residential Properties (excluding single family homes and duplexes) A. (Hotels, Motels, Apts., Time Share) Minimum fee $25.00 or fee for dwelling unit, whichever ..is greater 1.75 B. (Condominiums) 3 - 24 units $25.00 25 - 34 units 35.00 35 units and over 45.00 C. Additional safety inspections and test of the following systems: 1. Standpipe System $35.00 2. Sprinkler System 35.00 3. Fire Alarm System 35.00 4. Smoke Evaluation System 35.00 D. Re -inspection fees 1. First re -inspection - no additional charge 2. Second re -inspection fee and each _ subsequent re -inspection shall be 25% of the initial inspection fee. SECTION 2: Specific authority is hereby granted to codify this Ordinance. SECTION 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. _3_ Temp.
