Ord. #1326 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-87-IZ5- AN ORDINANCE AMENDING SECTION 2-5 OF THE CODE _ OF ORDINANCES OF THE CITY OF TAMARAC PERTAIN- ING TO THE BOARD OF CONSUMER AFFAIRS; PROVID- ING FOR MEMBERSHIP; CHANGING THE MEMBERSHIP FROM TWELVE (12) TO SEVEN (7) MEMBERS; PROVIDING FOR PROCEDURES FOR APPOINTMENTS AND THE SELECTION OF A CHAIRMAN; PROVIDING FOR MEETINGS, COUNCIL LIAISON, STAFF LIAISON, REMOVAL OF MEMBERS AND RESIGNATION OF MEMBERS; PROVIDING FOR DUTIES; PROVIDING FOR CODIFICATIION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac deter- mines that it is in the public interest to adopt the follow- ing Ordinance; and WHEREAS, Section 4.11 of the Charter for the City of Tamarac provides for the establishment of a consumer affairs board; and WHEREAS, the City Council is desirous of providing uniformity and increase efficiency in its board and committee system. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Section 2-5 of the Code of Ordinances of the City of Tamarac entitled, Board of Consumer Affairs is hereby amended to read as follows: -1- Temp. Ord. #1326 I 1 2 3 4 7 6 7 S 91 7 i] 31 32 33 34 35 Section 2-5. Board of Consumer Affairs. (a) Creation<- Memrerskrp>. The board shall be authorized to develop and activate programs designed for the protection of residents of the city in connection with purchases of residences, goods and services; receive and process consumer complaints and take or recommend necessary and appropriate action with respect thereto; recommend ordinances or resolu- tions designed to protect consumers; cooperate with other similar governmental agencies; and perform such other similar duties as may be prescribed by resolution of council. «ke beard -is--hereby-autherrred-te-use-the -professkenair-staff-art& £aeiiities-ef-the -erty-and-shaii -be -deemed-te b'e-arn-agene-rbt the-eei*meiiT> (c) Membership. The members of the board shall be a ointed b the council on an annual basis and serve at the pleasure of the council without compensation. The chairman of the board shall be appointed by the city council. (d) Rules of Procedure. The board shall conduct its meetings pursuant to Roberts Rules of Order and all applic- able laws. A quorum shall consist of a majority -of the membership. (e) Meetings. The board shall meet at least once a month at -a regularly scheduled time which is to be approved bythecity clerk. The board may determine its own vacation -2- t Temp. The board may have a_council liaison pursuant to the provisions of the Code of Ordinan- ces. (g)`, Staff Liaison. The board may have a staff person assigned to it by the city manager to serve in an advisor capacity. Any requests on the art of the committee for information or services from the administration shall be made by the chairman of the committee to the city manager or through the staff liaison if one is assigned. (h) Removal of Board Members. A board member appointed b the council serves at the pleasure of the council and shall be removed at anytime by majority vote of the council. (i) Resi nation of board members. A resignation_by a board member made either orally or in writing will be deemed accepted by the council when the board member announces his resignation to the board, city manager, or city council. The cit council need not take an formal action to acce t the resignation. Failure to attend 'three consecutive meetin s without being excused by the- chairman shall be deemed a resignation. SECTION 2: Specific authority is hereby granted to codify this Ordinance. I - SECTION 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. Ordinance No. 0-84-66 is hereby repealed in its entirety. SECTION 4: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect -3- Temp.
