ORDINANCE No. 0-87-.3v;2--
AN ORDINANCE AMENDING SECTION 2-9.2, ENTITLED
TRAVEL ALLOWANCE, OF THE CODE OF ORDINANCES
OF *THE CITY OF TAMARAC; ESTABLISHING NEW
CRITERIA FOR TRAVEL ALLOWANCES AND REIMBURSE-
MENTS FOR ELECTED OR APPOINTED CITY OFFICIALS
AND EMPLOYEES; PROVIDING FOR THE REPEAL OF
THE EXISTING SECTION 2--9.2 OF THE CODE OF
ORDINANCES; PROVIDING FOR A SUBSISTENCE
ALLOWANCE; PROVIDING FOR THE SUBMISSION OF
ITEMIZED VOUCHERS BEFORE REIMBURSEMENT;
PROVIDING FOR REIMBURSEMENT FOR
TRANSPORTATION COST; PROVIDING FOR INCIDEN-
TALS; PROVIDING FOR CODIFICATIION; PROVIDING
FOR REPEALER; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, a public hearing has been held pursuant to
Chapter 166, Florida Statutes; and
WHEREAS, the City Council of the City of Tamarac deter-
mines that it is in the public interest to adopt the follow-
ing Ordinance.
WHEREAS, it is in the public interest for elected or
appointed city officials and employees to attend educational
seminars and meetings which promote a more efficient form of
government; and
WHEREAS, on occasion elected or appointed city officials
and employees are required to travel to perform required
public tasks; and
WHEREAS, the City Council, in order to promote a more
equitable and efficient system for travel reimbursement is
desirous of amending the travel allowance section of the Code
of Ordinances of the City of Tamarac.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the existing Section 2-9.2, entitled
Travel Allowances, of the Code of Ordinances of the City of
Tamarac is hereby repealed in its entirety.

SECTION 2: That a new Section 2-9.2, entitled Travel
Allowances, of the Code of Ordinances of the City of Tamarac
is hereby created to read as follows;
Section 2-9.2 TRAVEL ALLOWANCES
(a) Intra-State Travel.
(1) Any travel that does not require, an elected
or appointed official or employees
(hereinafter "traveler"), to leave the State
of Florida does not require the approval of
the City Council. Except that all travel
within the state of Florida which entails
overnight expenses shall require prior Council
approval.
(2) Any traveler, not engaged directly by the City
Council, must first receive written authoriza-
tion from the City Manager before attending
any meeting or seminar within the state of
Florida in which the traveler seeks reimburse-
ment for expenses as provided for herein.
(b) Inter -State Travel.
(1) Any travel that requires a traveler to leave
the State of Florida requires prior approval
from the City Council. The approval shall be
in the form of a motion adopted by a majority
vote of the council members present.
(2) The City Council may ratify the out of state
travel on the part of a traveler if it
determines that there were justifiable reasons
for the traveler not to receive prior approval
and the travel clearly served the public's
interest.

(c) Subsistence Allowance.
(1) Travelers may be allowed for subsistence, when
on official business, the following amounts:
(a) Breakfast $8.00
(b) Lunch $12.00
(c) Dinner $20.00
(2) In order to claim breakfasts, travel must
begin before 6:00 a.m. ana exLexiu Lcyul-
8:00 a.m.; in order to claim lunches, travel
must begin before 12:00 noon and extend beyond
2:00 p.m.; and in order to claim dinners,
travel must begin before 6:00 p.m. and extend
beyond 8:00 p.m.
(3) For overnight travel, travelers may be allowed
the amount permitted in paragraph (c) of this
subsection for meals, plus actual expenses for
lodging at a single occupancy rate (or the
rate prescribed by the Seminar) and travel.
The hotel and room rate shall be approved in
advance whenever possible by the City Manager.
(d) Transportation.
(1) All travel must be by a usually traveled
route. In case a traveler travels by an
indirect route for his own convenience, any
extra costs shall be borne by the traveler.
(2) Transportation may be accomplished by either
common carrier, private carrier or city
carrier.
(3) whenever travel is by privately owned vehicle,
the traveler shall be entitled to a mileage
allowance of twenty one cents per mile ($.21)
from point of origin to point of destination
plus any additional mileage while at the point
of destination.

(4) No traveler shall be allowed either mileage or
transportation expense when he is gratuitously
transported by another person, or when he is
transported by another traveler who is
entitled to mileage or transportation ex-
penses.
(e) vouchers.
(1) All travelers must submit an itemized voucher
form, furnished by the Finance Director, prior
to being reimbursed as provided for herein.
(2) The voucher form shall be submitted within ten
(10) days after the travel has been completed.
(3) All vouchers must be approved by the Finance
Director and City Manager before payment is
effectuated.
(f) Incidentals.
(1) The following incidental traveling expenses of
the traveler may be reimbursed;
(a) communication expenses if related to
public business
(b) gratuities not to exceed 15% of the
service rendered
(c) registration fees for meetings or semi-

taxi or
limousine
fares
(e)
rental
car charges
approved by the City
Manager
(f ) parking fees.
(2) Notwithstanding any of the foregoing restric-
tions and limitations, the City Manager may
make, or authorize the making of, advances to
cover anticipated costs of travel to travel-
ers.

SECTION 3: Specific authority is hereby granted to
codify this Ordinance.
SECTION 4: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 5: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or.application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 6: This Ordinance shall become effective
immediately upon adoption and passage.

the traveler shall be entitled to a mileage

allowance of twenty cents per mile ($. from
point of origin to point of destination plus

any additional mileage while at the point of
destination.
(4) No traveler shall be allowed either mileage or
transportation expense when he is gratuitously
transported by another person, or when he is
transported by another traveler wno
entitled to mileage or transportation ex-
penses.
(e) Vouchers.
(1) All travelers must submit an itemized voucher
form, furnished by the Finance Director, prior
to being reimbursed as provided for herein.
(2) The voucher form shall be submitted within ten
(10) days after the travel has been completed.
(3) All vouchers must be approved by the Finance
Director and City Manager before payment is
effectuated.
(f) Incidentals.
(1) The following incidental traveling expenses of
the traveler may be reimbursed;
(a) communication expenses if related to
public business
(b) gratuities not to exceed 15% of the
service rendered
(c) registration fees for meetings or semi-
nars
(d) taxi or limousine fares
(e) rental car charges approved by the City
Manager
(f ) parking fees.
(2) Notwithstanding any of the foregoing restric-
tions and limitations, the City Manager may
make, or authorize the making of, advances to

cover anticipated costs of travel to travel-
ers.
SECTION 3:
Specific authority is hereby granted to
codify -this Ordinance.
SECTION 4 All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 5: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 6: This Ordinance shall become effective
immediately upon adoption and passage.
