AN ORDINANCE CREATING THE DEPARTMENT OF COMMUNITY DEVELOPMENT OF THE CITY OF TAMARAC; PROVIDING FOR FUNCTIONS TO BE PERFORMED BY THE DEPARTMENT; PROVIDING FOR A DIRECTOR OF COMMUNITY DEVELOPMENT; PROVIDING THAT ALL DUTIES CURRENTLY REQUIRED TO BE PERFORMED BY THE CITY PLANNER BY STATE STATUTE OR THE CODE OF ORDINANCES SHALL BE PERFORMED BY THE DIRECTOR OF COMMUNITY DEVELOPMENT; PROVIDING FOR STAFF; _PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac deter- mines that it is in the public interest to adopt the follow- ing Ordinance. WHEREAS, the City Council determines that it is in the public interest to establish a Department of Community Development due to the rapid growth occurring within the City of Tamarac; and WHEREAS, the Florida Legislature in recent years has extensively legislated the area of growth management in the state of Florida. NOW, THEREFORE, BE 'IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That a new chapter of the Code of Ordinances of the City Of Tamarac to be designated as Chapter 28(A) entitled, De artment of Community Development, is hereby established and is to read as follows: -1- Temp. Ord. #1341 1 2 3 4 6 7 8 9 10 11 12 13 14 15 16 7 3 19 20 21 22 23 24 25 ?6 27 28 29 01 31 32 33 34 35 Section 28A-4. Staff. The Director of Community Development shall desig- nate, with the approval of the City Manager, the appropriate staff necessary to perform the functions of the Department of Community Development. SECTION 2: Specific authority is hereby granted to codify this Ordinance. SECTION 3: All Ordinances or parts of Ordinances in conflict herewith a -re hereby repealed to the extent of such conflict. SECTION 4: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
