CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-87- 59
AN ORDINANCE OUTLINING REQUEST FOR VACATION
OF EASEMENT TO ALLOW AN ADDITIONAL STAIRWAY
FOR NATIONAL BUSINESS CENTER, LOT 2, BLOCK 12,
LYONS SUBDIVISION NO. 3; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac has received a request from Attorney Samuel
Cantor requesting a vacation of easement on platted lands identified as Lot 2,
Block 12, Lyons Subdivision No. 3 according to Plat Book 76, Page 31 of the Public
Records of Broward County, Florida; and
WHEREAS, Attorney Cantor has cited the details of an unnecessary hardship and
has stated the property has generated a hardship due to unusual and unnecessary
easement; and
WHEREAS, the property has to serve the neighbor in g properties for traffic
flow which inhibits this property for its use; and
.WHEREAS, the area to be vacated would be in an area of landscaped islands
which would not interfere with traffic circulation to the development for an additional
set of stairs for ingress and egress purposes at the property known as National
Business Center, 8400 University Drive, Tamarac, Florida; and
WHEREAS, the Building and Engineering Department staff have reviewed the request
for vacation of easement and have studied the area approved on the original site plan
where the additional set of stairs is currently encroaching and have found the
encroachment is within an existing landscaped island; and
WHEREAS, staff has no objections to the City Council of the City of Tamarac
approving this vacation request as outlined by Attorney Cantor; and -
WHEREAS, staff has no authorization to approve such vacation unless, or until,
a hardship cbn be proven and approved by City Council of the City of Tamarac.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the City of Tamarac acknowledges receipt of the letter from
Attorney Samuel Cantor requesting the vacation of easement on platted lands as
outlined on Lot 2, Block 12, Lyons Subdivision No. 3, and had indicated that the
stairway is existing in a landscaped easement previously.approved.

SECTION 2: That the City Council of the City of Tamarac recognizes an
unusual and unnecessary hardship exists at the property known as National Business
Center, 8400 University Drive, Tamarac, Florida.
SECTION 3: That the City Council of the City of Tamarac hereby authorizes
the vacation of the ingress/egress easement as depicted in Exhibit "A".
SECTION 4: If any provision of this Ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect
other provisions or applications of this Ordinance that can be given affect without
the inva.lid provision or application, and to this end the provisions of this Ordinan e
are declared to be severable.
SECTION 1: This Ordinance shall become effective immediately upon adoption
aitd passage.
