Ord. #1343 Rev. 9/3/87 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-87-� AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA AMENDING CITY CODE SECTION 28-171.014, HEIGHT, PROVIDING FOR PERSONS SEEKING TO ERECT STRUCTURES OR BUILDINGS WITHIN THE B-6 ZONE EXCEEDING THREE (3) STORIES OR FORTY (40) FEET IN HEIGHT MUST OBTAIN A SPECIAL EXCEPTION; PROVIDING IN NO EVENT SHALL SUCH BUILDINGS OR STRUCTURES EXCEED FIFTY (50) FEET IN HEIGHT; PROVIDING THAT ELEVATOR AND MECHANICAL EQUIPMENT ENCLOSURES AND STAIR TOWERS MAY EXCEED THE HEIGHT OF THE BUILDING BY FOURTEEN (14) FEET; PROVIDING FOR CRITERIA FOR SPECIAL EXCEPTION FOR B--6 HEIGHT REQUIRE- MENTS; PROVIDING AN AMENDMENT TO SECTION 28- 171.016, SETBACK REQUIREMENTS, PROVIDING SETBACKS ALONG UNIVERSITY DRIVE SHALL BE FIFTY (50) FEET FROM THE PROPERTY LINE RATHER THAN ONE HUNDRED TWENTY-FIVE (125) FEET FROM CENTER LINE OF ROADWAY; PROVIDING THAT PARKING IN FRONT, SIDE AND REAR SETBACK AREAS IN THE B-6 ZONE SHALL BE PERMITTED BY SPECIAL EXCEPTION; PROVIDING CRITERIA FOR SPECIAL EXCEPTION; PROVIDING FOR CONFLICTING ORDINANCES REPEALED; PROVIDING FOR CODIFICATIION; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : City Code Section 28-171.014, Height, of the Tamarac Code of Ordinances shall be amended so as to read in full as follows: Sec. 28-171.014. Height. No building or structure, or part thereof, shall be erected or altered to a height exceeding three (3) stories or forty (40) feet;. Persons seeking to erect buildings or structures exceeding three (3) stories or fort (40) feet in height must obtain a special exception. In no event shall buildings or structures, including -those approved b special exception, exceed_ fifty (50) feet in height. SECTION 2 Section 28-171.016, Setback Requirements, of the Tamarac Code of Ordinances shall be amended so as to read in full as follows: Sec. 28-171.016. Setback Requirements. In the B--6 district the following setbacks are required: (1) Street: twenty --five (25) feet generally. Street setbacks along University Drive shall be one hundred twenty-five (125) feet from center line of roadway. fifty (50) feet from the property line. Driveways are permitted in street setbacks. (2) Interior lot line (side or rear): twenty (20) feet. (3) No parking shall be permitted within any required street setback; and where a B-6 district abuts any residentially zoned district, no parking shall be permitted within the required lot line setback area adjacent to the residentially zoned property. Parking in front, side and rear setback areas in the B-6 zone shall be permitted by s ecial exce - tion. The criteria which shall be considered when determining_whether to grant a special exception pursuant to this section shall be as follows: 1. SECTION 3 : Specific authority is hereby granted to codify this Ordinance. SECTION 4 : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5 If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. My name is Burton Schneider and I am President of the Woodmont Property Owners Association, a group of close to 1,200 families, and I address you this evening on their behalf. The Woodmont Property Owners Association is NOT a politically oriented organization. This is borne out by the fact that this evening is the 1st time I have appeared before this august body and I have been in office since December 1986. The WPOA is proud of the manner in which our city officials have carried out the daily tasks of running our city. However, on August 19, 1987 I was deluged by phone calls from Woodmont property owners asking me about a 72' building going to be built in front of Woodmont. I then found a notice in the News & Sun Sentinel for this public hearing which I quote in part: "Temp. ordinance 1343 amending Sec. 28-171.014, height, providing for persons seeking to erect structures within B-6 zone exceeding 3 stories or 40' in height must obtain a special exception; providing that no building may exceed 72' in height." Then on Tuesday, August 25, there appeared another notice in the News & Sun Sentinal for another public hearing on September 9 which says "Notice of public hearing petition #19-Z-87 petetioner Weicholz & Gordon Inc.," and I excerpt from, rather than bore everyone by reading the entire notice "To hear a request for special exception for construction of a building 72' in height on the following hereinafter legally described B-6, business district zoned lands". I have included copies of both notices in their entirety so they may become a part of the record. We strongly oppose the use change in zoning code that would allow a 72' building to be built on University Drive. The City of Tamarac has in the past rejected any proposed change in building height to keep the asthetic continuity of our small city, except for the University Hospital. We the citizens have continuously supported this stand and beseach you to stick to your policy and not make any last minute changes that would add to the congestion of University Drive, create additional pollution and begin a concrete jungle on the existing land on University Drive and any other commercially zoned property. We feel certain that if this exception is granted it would open the door and set the precedent for many more requests for tall buildings in Tamarac. How could you refuse other requests after granting this one? We fully understand that the land is commercially zoned and that we cannot, nor do we wish to stop anyone from using the land for its designated purpose.
