Ord. # lam_ CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-87--�:-6j"L AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY FROM R-4A (PLANNED APARTMENTS) AND R-3 (LOW DENSITY MULTIPLE DOELLING) TO B-6 (BUSINESS DISTRICT) UTILIZING THE 5% FLEXIBILITY RULE FOR COMMERCIAL DEVELOPMENT IN A RESIDENTIAL LAND USE AREA NOT TO EXCEED TEN ACRES; LANDS DESCRIBED AS BEING A PORTION. OF TRACTS-15 AND 18 OF THE FORT LAUDERDALE TRUCK FARMS SUBDIVISION AS RECORDED IN PLAT BOOK 4, PAGE 31, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (OTHERWISE IDENTIFIED AS LANDS AT THE REAR OF VHE EXISTING HCA UNIVERSITY COMMUNITY HOSPITAL, 7201 NORTH UNIVERSITY DRIVE, AND A PART OF THE PROPOSED UNIVERSITY HOSPITAL PAVILLION); PETITION 24-Z-87; PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR SEVERABILITY; AND .ROOM IWA_M AEE&CTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the zoning of the property described herein and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and the Council has examined and investigated the request for the zoning herein and has received the recommendation of the Planning Commission of the City of Tamarac; and WHEREAS, public hearing has been held on Petition 24-Z-87 by the City Council, pursuant to the Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: ` SECTION l: That those lands described in Exhibit W attached hereto and made a part hereof are hereby rezoned from R-4A (Planned Apartments) and R-3 (Low Density Multiple Dwelling) to B-6 (Business District) utilizing the 5% flexibility rule for commercial development in a residential land use area not to exceed ten acres. SECTION 2: That the Official Zoning Map of the City of Tamarac shall be changed to reflect in the rezoning, said changes to be initialed by the Mayor and the City Clerk, together with the effective date of this Ordinance. 1 S 3 4 5 6 Temp. Ord. # 1359 SECTION-3: All Ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affet the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. ,SECTiQN 5: This Ordinance shall become effective immediately upon its passage.
