AN ORDINANCE AMENDING SECTION 2-7 OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC RELATING TO THE PUBLIC INFORMATION BOARD; PROVIDING THAT ALTERNATE MEMBERS ARE AUTHORIZED TO REPLACE ABSENT REGULAR MEMBERS SUBJECT TO APPROVAL OF THE CHAIRMAN; PROVIDING FOR RULES AND PROCEDURES RELATING TO THE PUBLIC INFOR- MATION BOARD; PROVIDING FOR PROCEDURES TO REMOVE ALTERNATE AND REGULAR MEMBERS FROM THE BOARD; PROVIDING FOR PROCEDURES RELATING TO RESIGNATION OF REGULAR AND ALTERNATE BOARD MEMBERS; PROVIDING FOR CODIFICATIION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac deter- mines that it is in the public interest to adopt the follow- ing Ordinance; and WHEREAS, Section 4.10 of the Charter for the City of Tamarac provides for the establishment of a Public Informa- tion Board; and WHEREAS, the City Council is desirous of making certain amendments to Section 2-7 of the Code of Ordinances of the City of Tamarac entitled "Public Information Board". NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : That Section 2-7(a) of the Code of Ordinances of the City of Tamarac relating to the public information board and entitled "Creation" is hereby amended to read as follows: (a) Creation: A public information board is hereby created as a permanent agency of the City and shall consist of five ( 5 ) regular members and two 2 ) alternate members appointed by the council. If a re ular member is unable -to -,attend a meeting of the board, an alternate member ma with the approval -1- Temp. Ord. #1368 1 2 3 4 5 6 7 B 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 of the chairman, take the place of the regular member at that meeting. For the duration of that meetipg,. such alternate members shall have all rights and duties accorded a regular member. SECTION 2 That Section 2-7(d) of the Code of Ordinances of the City of Tamarac relating to the public information board and entitled "Memberships compensation" is hereby amended to read as follows: (d) Membership; compensation: The regular and alter nate members of the board shall be appointed by the council on an annual basis and serve at the pleasure of the council without compensation. The chairman of the board shall be appointed by the city council. SECTION 3 : That Section 2-7(e) of the Code of Ordinances of the City of Tamarac relating to the public information board and entitled "Rules of procedure" is hereby amended to read as follows: (e) Rules of procedure: The board shall conduct its meetings pursuant to Roberts Rules of Order and all applicable laws. A quorum shall consist of a majority of the regular, membership. Alternate members filling in for an absent regular member shall be counted for purposes of determining the presence of a quorum at an articular meeting. SECTION 4 : That Section 2-7(i) of the Code of Ordinances of the City of Tamarac relating to the public information board and entitled "Removal of board members" is hereby amended to read as follows: (i) Removal of board members: A regular or alternate board member appointed by the council serves at the pleasure of the council and shall be removed at any time by a majority vote of the council. SECTION 5 : That Section 2-7(j) of the Code of Ordinances of the City of Tamarac relating to the public information board and entitled "Resignation of board members" 6 V -2- Temp. Ord. #1368 11 2 3 4 5 6 is hereby amended to read as follows: U) Resignation of board members: A resignation by a regular or alternate board member made orally or in writing will be deemed accepted by the council when the regular or alternate board member announces his resignation to the board, city manager or city council. The city council need not take any formal action to accept the resignation. Failure of a regular member to attend three (3) consecutive meetings without being excused by the chairman shall be deemed a resignation. SECTION 6 : Specific authority is hereby granted to codify this Ordinance. SECTION 7 : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 8 If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
