Ord. # 1316 Revised 1/8/88 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-88— S AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES; AMENDING SECTION 28-11 "MASTER LIST ENUMERATION", BUSINESS USE; PERTAIN— ING TO OUTDOOR (SIDEWALK) SALES; REQUIRING FEES, APPLICATIONS, AND CONDITIONS FOR OUTDOOR (SIDEWALK) SALES; PROVIDING FOR CODIFICATIION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac determines that it is in the public interest to adopt the following ordinance; and WHEREAS, the following amendment will ensure that Outdoor (Sidewalk) Sales are conducted in a safe and organized manner. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 Code Section 28-171 of the Code of Ordinance, follows: Master List Enumerated is hereby amended as Outdoor (sidewalk) sales: (1) For a limited, temporary period of time not to exceed four (4 ) days. (2) In conjunction with an,authorized, licensed business use verified by the su ervisor of occu ational licenses. (5) The application must be submitted ten (10) working days 2rior to sidewalk sale, -in writing, to the supervisor of occupational license with a permit fee of five $5.00) dollars. 6) Outdoor stora a/dis la of merchandise shall not im ede normal pedestrian movement via the sidewalk or interfere with the entrance/exit of the subject remises or that of adjacent businesses. SECTION 2 : Specific authority is hereby granted to codify this Ordinance. SECTION 3 : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4 If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
