Ord. #1381 Revised 4/21/88 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-88--/0-7- AN ORDINANCE -OF THE CITY OF TAMARAC AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC PERTAINING TO ZONING; AMEND- ING ARTICLE XIV S-1 RECREATIONAL DISTRICT SECTION 28-129(b) TO PROVIDE THAT PUBLIC GOLF COURSES SHALL BE A PERMITTED USE IN THE S-1 RECREATIONAL DISTRICT; PROVIDING THAT A DINING ROOM, BAR AND GRILL AND SNACK BAR MAY BE OPERATED AT A PUBLIC OR PRIVATE COUNTRY CLUB THROUGH SPECIAL EXCEPTION APPROVAL; PROVIDING THAT NO EXTERNAL ADVERTISING OF SAID DINING ROOM, BAR AND GRILL AND SNACK BAR SHALL BE PERMITTED; PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, public golf courses customarily serve food and beverages; and WHEREAS, the primary users of such facilities are those golfers using the public golf course itself; and WHEREAS, the City Council of the City of Tamarac has determined that it is in the public interest to adopt the following Ordinance; and WHEREAS, a public hearing has been held pursuant to Chapter 163, Florida Statutes: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 That Article XIV, S-1 Recreational District, Section 28-129 of the Code of Ordinances of the City of Tamarac, entitled "Permitted Uses" is hereby amended to read as follows: -1- Temp. Ord. #1381 Sec. 28-129. Permitted uses. No building or structure, or part thereof, shall be erected, altered or used, or land or water used, in whole or in part, for other than one or more of the following speci- fied uses; a enb�ect-te-the-procedure-specified-in-section- 2e-lai: (a) Public or -private country club. A dining room, bar and grill and snack bar may be o erated at a public or private country club through special exce tion approval of the city council. Such special exception approval shall be consistent with the provisions governing_ special exceptions as set out in this Code and consistent with the regulations concerning restaurants in Section 28 171 as amended. No external advertising -of said dining room bar and rill and snack bar shall be permitted. (b) Golf course. (c) Shuffleboard court. (d) Swimming pool. (e) Tennis courts. (f) Neighborhood or community club operated by non- profit or public corporation. (g) Public parks and open spaces. The operation of any recreation area shall, regardless of anything else in this chapter, be subject to the reason- able control and direction of the city and the city council as regulatory authorities. -2- Temp. SECTION 3 : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4 If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
