Ord. #1388 1 2 3 14 1� 8 •9 10 21 12 13 14 15 16 17 a 20 21 22 23 24 25 26 27 28 29 30 33 34 35 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-88-_L� AN ORDINANCE VACATING THE INTERIOR 3-FEET OF THE 15-FOOT UTILITY EASEMENT SURROUNDING BLOCK 4 OF THE LANDINGS ON CYPRESS GREENS AS RECORDED IN PLAT BOOK 131, PAGE 31; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: FINDINGS OF FACT A determination is hereby made by the City Council that the interior 3-feet of the 15-foot utility easement surrounding Block 4 of The Landings On Cypress Greens as recorded in Plat Book 131, Page 31, described on Exhibit "A" is no longer needed for public purposes and, accordingly, the interest should revert to the private party(ies) owning the property burdened by the utility easement to be vacated. SECTION 2: That the interior 3--feet of the 15-foot utility easement described in Exhibit "A", attached hereto and made a part hereof, is hereby abandoned, vacated and extinguished by the City Council of the City of Tamarac, Florida, and such utility easement shall no longer be deemed property to be used for public purposes on behalf of the people of the City of Tamarac, Florida. SECTION 3: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
