Ord. #1391 t 1 2 3 4 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 '1 32 33 34 35 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-88-L-15- AN ORDINANCE OF THE CITY OF TAMARAC RELATING TO COMMERCIAL VEHICLES; AMENDING ARTICLE 11, DIVISION 2, SECTION 15-6(b)(1) OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC ENTITLED "DEFINITIONS" TO PROVIDE THAT THE DEFINITION FOR "COMMERCIAL VEHICLES" SHALL INCLUDE LIMOUSINES AND OTHER VEHICLES FOR HIRE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code of Ordinances of the City of Tamarac currently prohibits the overnight parking of commercial vehicles in residentially zoned districts; and WHEREAS, the City Council of the City of Tamarac wishes to expand the definition of commercial vehicles as set out in the Code to include limousines and other vehicles for hire; and WHEREAS, pursuant to Chapter 166, Florida Statues, a public hearing has been held on this proposed Ordinance; and WHEREAS, the City Council of the City of Tamarac has determined that adoption of this Ordinance is in the public interest; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 That Article II, Division 2, Section 15-6(b)(1) of the Code of Ordinances of the City of Tamarac is hereby amended to read as follows: Sec. 15-6. Parking or storage of commercial or recreational vehicles, boats or boat trailers. (b) Definitions. (1) Commercial vehicle shall refer to any vehicle which MC Temp. Outside lettering of any such vehicle designating a business of any kind shall be one, but not the only, method of establishing its commercial status. The following types of vehicles shall be considered commercial for purposes of this section: Truck cab Trailer Semitrailer Tractor crane Power shovel Well driller Bus Taxi, limousines and other vehicles for hire Ambulance Wrecker (tow truck) Hearse (2) Recreational vehicle shall refer to a vehicular, portable structure which is built on a chassis; which is designed as a temporary dwelling for travel, recreation or vacation; and which has a transportable body width not exceeding eight (8) body feet and a length not exceeding thirty-five (35) feet. • (3) Mobile home shall refer to a structure which is transportable in one (1) or more sections, which is eight (8) body feet or more in width and is thirty- two (32) body feet or more in length, which is built on a permanent chassis, and which is designed to be used as a dwelling with or without a perman- ent foundation when connected to the required utilities. (4) Boat or boat trailer shall refer to any boat, yacht or vessel, regardless of size or motor capacity, t I -2- Temp. (5) Other definitions provided in F.S. ss. 320.01 are hereby incorporated by reference. SECTION 2 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. SECTION 3 : Specific authority is hereby granted to codify this Ordinance. SECTION 4 : This Ordinance shall become effective immediately upon adoption and passage. It lists Commercial Vehicles, Recreational Vehicles, boat or boat trailer, and states "No Parking" unless certain conditions are met, from 9:00 p.m. until 6:00 a.m. (b) gives definitions. 1) "Commercial vehicles shall refer to any vehicle which is not used solely for personal non -business activities. Outside lettering on any such vehicles designating a business of any kind shall establish its commercial status." I believe any "reasonable"' person reading that Section would determine an unlettered pick-up or panel truck of common size, z or 3/4 ton capacity could or would be for personal non -business activity. I believe any "reasonable" person would conclude that a truck or vehicle of larger capcity just by nature of its purchase price and cost to operate would not be a vehicle for personal, non --business activity. Using that word "reasonable" Is acceptable to most courts and Code Enforcement Boards. I would feel our ordinance as amended fills the needs of Tamarac presently. The other alternative would be to include pick-ups and panel trucks in the definitions. I believe that action would cause chaos. I recommend the passage of Temporary Ordinance #1391 on second reading tin -amended. I t 1 2 3 4 5 b 7 8 �J 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 '1 32 33 34 35 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-88-,L�?- AN ORDINANCE OF THE CITY OF TAMARAC RELATING TO COMMERCIAL VEHICLES; AMENDING ARTICLE 11, DIVISION 2, SECTION 15-6(b)(1) OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC ENTITLED "DEFINITIONS" TO PROVIDE THAT THE DEFINITION FOR "COMMERCIAL VEHICLES" SHALL INCLUDE LIMOUSINES AND OTHER VEHICLES FOR HIRE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE. _ WHEREAS, the Code of Ordinances of the City of Tamarac currently prohibits the overnight parking of commercial vehicles in residentially zoned districts; and WHEREAS, the City Council of the City of Tamarac wishes to expand the definition of commercial vehicles as set out in the Code to include limousines and other vehicles for hire; and WHEREAS, pursuant to Chapter 166, Florida Statues, a public hearing has been held on this proposed Ordinance; and WHEREAS, the City Council of the City of Tamarac has determined that adoption of this Ordinance is in the public interest; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 That Article II, Division 2, Section 15-6 (b) (1) of the Code of Ordinances of the City of Tamarac is hereby amended to read as follows: Sec. 15-6. Parking or storage of commercial or recreational vehicles, boats or boat trailers. (b ) Definitions. (1) Commercial vehicle shall refer to any vehicle which M.0 Temp. Outside lettering of any such vehicle 1 designating a business of any kind shall be one, 2 but not the onl , method of establishing its 3 commercial status. 4 5 The following types of vehicles shall be considered 6 commercial for purposes of this section: 7 Truck cab 8 Trailer 9 Semitrailer 10 Tractor crane 11 Power shovel 12 Well driller 13 Bus 14 Taxi, limousines and other vehicles for hire 15 Ambulance 16 Wrecker (tow truck) 17 Hearse 18 19 (2) Recreational vehicle shall refer to a vehicular, 20 portable structure which is built on a chassis; 21 which is designed as a temporary dwelling for 22 travel, recreation or vacation; and which has a 23 transportable body width not exceeding eight (8) 24 body feet and a length not exceeding thirty-five 25 (35) feet. 26 (3) Mobile home shall refer to a structure which is 27 transportable in one (1) or more sections, which is 28 eight (8) body feet or more in width and is thirty- 29 two (32) body feet or more in length, which is � 30 built on a permanent chassis, and which is designed 31 to be used as a dwelling with or without a perman-- 32 ent foundation when connected to the required 33 utilities. 34 (4) Boat or boat trailer shall refer to any boat, yacht 35 or vessel, regardless of size or motor capacity, -2- Temp. (5) Other definitions provided in F.S. ss. 320.01 are hereby incorporated by reference. SECTION 2 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. SECTION 3 : Specific authority is hereby granted to codify this Ordinance.
