Ord. #1389 1 CITY OF TAMARAC, FLORIDA 2 ORDINANCE No. 0-8846f 3 4 AN ORDINANCE AMENDING CHAPTER 27 OF THE TAMARAC CITY CODE PERTAINING TO WATER & SEWER 5 UTILITIES OWNED AND OPERATED BY THE CITY OF TAMARAC; AMENDING SECTION 27, ARTICLE I, 6 SECTION 27-33 OF THE CITY CODE RELATING TO SURCHARGES FOR CUSTOMERS OUTSIDE OF THE CITY 7 LIMITS; DELETING AND REPEALING IN ITS ENTIRETY SECTION 27, ARTICLE I, SECTION 27- 8 36.3 OF THE CITY CODE RELATING TO THE EAST UTILITY REVENUE GENERATION SYSTEM REQUIRE- 9 MENTS; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; 10 AND PROVIDING AN EFFECTIVE DATE. 11 WHEREAS, a public hearing has been held pursuant to 12 Chapter 166, Florida Statutes; and 13 WHEREAS, the City Council of the.City of Tamarac deter-- 14 mines that it is in the public interest to adopt the follow- 15 ing Ordinance. 16 17 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF 18 THE CITY OF TAMARAC, FLORIDA: 19 20 SECTION 1 : That Chapter 27 Article I, Section 27--33 of 21 the Code of Ordinances of the City of Tamarac is hereby 22 Amended to provide as follows: 23 24 Sec. 27-33 Customers Outside City Limits, Water 25 26 Customers outside of corporate limits of the City 27 receiving water service shall, in addition to the rates set, 28 pay a surcharge of ne--less-there twenty-five (25) per cent of 29 the water bill before the addition of the surcharge or such 30 greater amount authorized by general law and established by 31 resolution of the City Council. 32 33 SECTION 2: That Chapter 27, Article I, Section 27-36.3 34 of the Code of Ordinances of the City of Tamarac is hereby 35 repealed and deleted in its entirety as follows: -1- iim— Temp. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not effect other provisions or applications of this Ordinance that can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. WATER AND SEWER EXTENSION POLICY Sec. 27-51. Contribution charges. a) The city declares that it shall require developers to contribute a portion of the cost of plant facilities. Such contributions, by developers, owners or builders, are defined herein as "contribution charges." b) The city requires, at the time of site plan approval, an executed developers agreement containing a provision setting forth a schedule for payment of all water and sewer, or either as applicable, contribution charges. r Contribution charges for all projects shall be due and payable no later than the time of final site plan approval. The moneys are not to be treated as revenue to the utility. c) Definitions: EQUIVALENT RESIDENTIAL CONNECTION (ERC): The .assuffied average daily flow of a single residential unit Z alculated by the City Engineer. COMMERCIAL: All property devoted to indust- rial, business, educational or other cate- gories not residential in nature shall be considered to be commercial uses. The contribution charges to be paid to the city for such proposed uses shall be based upon determining the residential equivalency of such proposed use as calculated by the City Engineer .
