Ord. 1390 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-88-_/_7 AN ORDINANCE OF THE CITY OF TAMARAC RELATING TO RATES AND CHARGES APPLICABLE TO CITY OF TAMARAC UTILITIES; AMENDING SECTION 27-51(b) RELATING TO PAYMENT OF CONTRIBUTION CHARGES; AMENDING THE DEFINITION FOR EQUIVALENT RESIDENTIAL CONNECTION (ERC); PROVIDING FOR A METHOD TO DETERMINE THE RESIDENTIAL EQUIVA- LENCY FOR COMMERCIAL WATER USES; PROVIDING FOR A METHOD TO DETERMINE THE RESIDENTIAL EQUIVALENCY FOR IRRIGATION WATER USES; DELETING OUTDATED PROVISIONS RELATING TO METER SIZE AND ITS RESIDENTIAL EQUIVALENCY FACTOR. FOR IRRIGATION USES; PROVIDING FOR REPEALER; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac determines that it is in the public interest to adopt the following Ordinance; and WHEREAS, Section 27-35 and Section 27-36 of the Code of Ordinances of the City of Tamarac provide that the rates and charges applicable to City of Tamarac Utility East and City of Tamarac Utility West shall be established by resolution of the City Council; and WHEREAS, pursuant to that Code Section the City of Tamarac has adopted a series of Resolutions setting the rates and charges for the City's utilities, the most recent being Resolution No. R-87-334; and WHEREAS, the recent CIAC rate study conducted by the City's consultant Hazen and Sawyer has determined that the assumed average daily water flow of a single residential unit is two hundred four (204) gallons per day; and WHEREAS, the City Council of the City of Tamarac wishes to amend the Code of Ordinances so as to be consistent with the results of the Hazen and Sawyer study; ow Temp. Ord. #1390 1 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF 2 THE CITY OF TAMARAC, FLORIDA: 3 4 SECTION 1 That Section 27-51 of the Code of Ordi- 5 nances of the City of Tamarac is hereby amended to read as n follows: 7 8 Sec. 27--51. Contribution charges. 9 (a) The city declares that it shall require developers 10 to contribute a portion of the cost of plant facilities. 11 Such contributions, by developers, owners or builders, are 12 defined herein as "contribution charges." 13 (b) The city requires, at the time of site plan ap- 14 proval, an executed developers agreement containing a 15 provision setting forth athe cost of 16 all water and sewer, or either as applicable, contribution 17 charges. Contribution charges for all projects shall be due 8 and payable no later than the time of final site plan �9 approval. The contribution charges to be paid to the city for such proposed uses shall be based upon determining the residential equiva- lency of such proposed use. The city engineer shall estimate the anticipated water consumption on a daily basis and shall divide such gross daily consumption by s-faeter-ef--thee hdndred-fifty-J358} the flow of one (1) ERC in gallons per day to determine the residential equivalencv for commercial use Such residential equivalency factor shall be multiplied by the contribution charges then in effect for single-family residential use in order to determine the charges applicable to such proposed commercial use. No commercial use shall be less than one (1) residential equivalent. Irrigation uses: Contribution charges for water service used for the purpose of irrigation shall be based --on the-size-of--meter--inste.11ed-in-accerdance-with-the-fallowing sehe6ule: based u on the residential equivalency --of such use. The city engineer shall determine the daily water consumption for the proposed irrigation use and shall divide such gross daily water consumption amount by the flow of one (1) ERC er day to determine the residential e uivalenc for the proposed irri ation use. Reatdent.ial Meter -Size Equivaiency {inehea} Factor (d) Water Service Only; Sewer Service Only: In any instance where either water or sewer service alone is furnished without the companion service, the charges shall be as established by the city's rate schedule. SECTION 2 All sections or parts of sections of the Code of Ordinances, all ordinances or parts of ordinances and -3- Temp. SECTION 3 Should any section or provision of this ordinance, or any portion thereof, or any paragraph# sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not .affect the validity of the remainder hereof, as a whole or a part hereof, other than the part declared to be invalid; SECTION 4 : it is the intention of the City Council that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances and that the sections of this ordinance may be renumbexed or relettered and the words "Ordinance" may be changed to "Chapter", "Section", "Article" or such other appropriate word or phrase, the use of which shall accomplish the intentions herein expressed.
