AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA
RELATING TO FLOOD HAZARD DISTRICTS; PROVIDING
FOR ADDITIONAL EXAMPLES OF FLOODPROOFING;
PROVIDING FOR AN AMENDED DEFINITION OF THE
TERM "STRUCTURE"; PROVIDING FOR ADDITIONAL,
REGULATIONS PERTAINING TO NEW CONSTRUCTION
AND IMPROVEMENTS THAT ARE BELOW THE LOWEST
FLOOR AND THAT ARE SUBJECT TO FLOODING;
PROVIDING FOR CODIFICATIION; PROVIDING FOR
REPEALER; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, a public hearing has been held pursuant to
Chapter 166, Florida Statutes; and
WHEREAS, the City Council of the City of Tamarac has
determined that it is in the public interest to adopt the
following amendments to Chapter 10A of the Code of Ordinances
of the City of Tamarac;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1 : That Chapter 10A, Section 10A-1 entitled
"definitions" ofthe Code of Ordinances of the City of
Tamarac is hereby amended to read as follows:
Sec. 10A-1. Definitions
For the purposes of this chapter, the following defini-
tions shall apply:
(a) General flood hazard district (hereinafter referred
to as GFH district) means that portion of the city
comprised of those areas designated upon the
official flood insurance rate map issued and
approved by the Federal Insurance Administration,
dated February 15, 1978, and numbered Community
Panel Number 120058 0001 B; 120058 0002 B; 120058
0003 B; and as the same may from time to time be
amended by the Federal Insurance Administrator.
(b) Flood or flooding means a general and temporary
condition of partial or complete inundation of
normally dry land areas from (a) the overflow of
streams, rivers, or other inland water, or (b)
abnormally high tidal water or rising coastal
waters resulting from severe storms, hurricanes, or
tidal wave.
(c) Floodproofing means structural and nonstructural
additions, changes, or adjustments (other than
elevating) to structures and utilities which reduce
or eliminate flood damage to water supply and
sanitary sewage facilities, structures and contents
of buildings, and includes, by way of illustration,
not limitation, the following measures:
(1) Anchorage to resist flotation and lateral
movement.

(2) Installation of watertight doors, bulkheads,
and shutters, or similar methpds of construc-
tion to protect against winds, wave action,
or floodwaters.
(3) Reinforcement of walls to resist water
pressures.
(4) Use of paints, membranes, or mortars to
reduce seepage of water through walls.
(5) Addition of mass or weight to structures to
resist flotation.
(6) Installation of pumps to lower water levels
in structures.

(9) Construction to resist rupture or collapse
caused by water pressure on floating debris.
(10) Installation of valves or controls on sani-
tary and storm drains which will permit the
drains to be closed to prevent backup of
sewage and storm waters into the buildings or
structures. Gravity draining of basements
may be eliminated by mechanical devices.

and located so as to prevent water from
enterin or accumulatin within the compo-
nents during conditions of flooding_
(12) Location of any structural storage facilities
for chemicals, explosives, buoyant materials,
flammable liquids or other toxic materials
which could be hazardous to public health,
safety, and welfare in a manner in which will
assure that the facilities are situated at
elevations above the height associated with
the regulatory protection elevation or are
adequately floodproofed to prevent flotation
of storage containers, or damage to storage
containers which could result in the escape
of toxic materials into floodwaters.

(d) Regulatory flood (also herein referred to as 100-
year flood) means the level of flooding that, on
the average, is likely to be equaled or exceeded
once in any 100-year period (i.e., that has a one
per cent chance of occurring in any year). For
purposes of this chapter the regulatory shall be
that elevation as established by the Federal
Insurance Administration, 100-year flood standard
as published on the Flood Insurance Rate Map (FIRM)
for the city, together with revisions thereto,
which may be made from time to time.
(e) Substantial improvement means any repair, recon-
struction, or improvement of a structure, the cost
of which equals or exceeds fifty (50) per cent of
the market value of the structure either (a) before
the improvement is started, or (b) if the structure
has been damaged and is being restored, before the
damage occurred.
(f) Structure means-anything-eenstrueted-or-ereeted-the
t�ae-ef-which-requires-rigid-ieeatien-en-the-grennd;
or--attaehment--te--semething--�iaving--a--permanent
ieeatxen-en-tine-gret�.nd;-ineit�ding-baildings;-weiis;
fences;-signs;-itgh.t-standards;-tewers;-tanks;-ete-
means anvthina constructed or erected the use of
which requires rigid location on the ground, or
attachment to something having a ermanent loca-
tion on the round, including buildings, walls,
fences,_ signs, light standards, towers, tanks,
mobile homes, and manufactured housing, Permits
must be obtained for all of the above, and _ only
issued if they are within a f lood rone area, if
they -are -designed to be anchored to prevent flota-
tion, collapse, and to resist lateral movement of
the structure resulting from h drodnamic and
hydrostatic loads including buoyancy.
(g) Accessory building means a secondary residence,
garage, or other building or structure on a lot or
parcel subordinate to and not forming an integral
part of the main or principal building but pertain-
ing to the use of the main building. An accessory
building may include a guest house or servants'
quarters unless prohibited by existing deeds restr-
ictions or any applicable governmental regulation.
(h) Residential. The term "residential" or "residence"
is applied herein to any lot, plot, parcel, tract,
area or piece of land or any building used exclu-
sively for family dwelling purposes or intended to
be so used, including concomitant uses as specified
in Chapter 28 of this Code.
(i) Basement means that portion of a building between
floor and ceiling, which is so located that one-
half or more of the clear height from floor to
ceiling is below grade.
SECTION 2 : That Chapter 10A, Section 10A-2 entitled
"Development in GFH districts - building permit requirements"
is hereby amended to create a new subsection (1) to read as
follows:
The municipal official responsible for the administra-
tion and enforcement of this chapter shall (to the
extent not otherwise prohibited by Section 10A-3) with
respect to development within GFH districts:

(1) Require that all new construction and substantial
improvements_ that fully enclose areas below the
lowest floor_ and that are subject _to flooding be
designed to automatically equalize hydrostatic
flood forces on exterior walls by allowing for the
entry and exit oo wa ers. esi ns or mee an
this requirement must either be certified b a
registered rofessional engineer or architect or
meet or exceed the following minimum criteria: A
minimum of two openings having a_total net area of
not less than one square inch for every square foot
of enclose_ d area subject to flooding must be
provided." The bottom of all openings must be no
higher than one foot above grade. openings may be
equipped with screens, louvers, valves, or other
coverings or devices rovided that they permit the
automatic entry and exit of floodwaters."
SECTION 3 Specific authority is hereby granted to
codify Ordinance.
SECTION 4 : All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 5 : If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and -to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 6 This Ordinance shall become effective
immediately upon adoption and passage.

WHEREAS, a public hearing has been held pursuant to
Chapter 166, Florida Statutes; and
WHEREAS, the City Council of the City of Tamarac has
determined that it is in the public interest to adopt the
following amendments to Chapter 10A of the Code of Ordinances
of the City of Tamarac; Now Therefore,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1
"definitions" of

That Chapter 10A, Section 1OA-1 entitled
Code of Ordinances of the City of Tamarac is
read as follows:
Sec, 10A-1. Definitions
Foi the purposes of this chapter, the following def ini-
tions shall apply:
(a) General flood hazard district (hereinafter referred
to as GFH district) means that portion of the city
comprised of those areas designated upon the
official flood insurance rate map issued and
approved by the Federal Insurance Administration,
dated February 15, 1978, and numbered Community
Panel Number 120058 0001 B; 120058 0002 B; 120058
0003 B; and as the same may from time to time be
amended by the Federal Insurance Administrator.
(b) Flood or flooding means a general and temporary
condition of partial or complete inundation of
normally dry land areas from (a) the overflow of
streams, rivers, or other inland water, or (b)
abnormally high tidal water or rising coastal,
waters resulting from severe storms, hurricanes, or
tidal wave.
(c) Floodproofing means structural and nonstructuro.: al
additions, changes, or adjustments (other than
elevating) to structures and utilities which reduce
or eliminate flood damage to water supply and
sanitary sewage facilities, structures and contents
of buildings, and includes, by way of illustration,
not limitation, the .following measures:
(1) Anchorage to resist flotation and lateral
movement.

(2) Installation of watertight doors, bulkheads,
and shutters, or similar methods of construc-
tion to protect against winds, wave action,
or floodwaters.
(3) Reinforcement of walls to resist water
pressures.
(4) Use of paints, membranes, or mortars to
reduce seepage of water through walls.
(5) Addition of mass or weight to structures to
resist flotation.
(6) Installation of pumps to lower water levels
in structures.

(8) Pumping facilities or comparable practices
for subsurface drainage systems for buildings
to relieve external foundation wall and base-
ment flood pressures. '
(9) Construction to resist rupture or collapse
caused by water pressure on floating debris.
(10) Installation of valves or controls on sani-
tary and storm drains which will permit the
drains to be closed to prevent backup of
sewage and storm waters into the buildings or
structures. Gravity draining of basements
may be eliminated by mechanical devices.

Electrical, heating and ventilating,
plumbing, air conditioning equipment and
other service facilities designed, installed
and located so as to prevent water from
_enterin2 or accumulating within the compo-
nents during conditions of flooding.
(12) Location of any structural storage facilities
for chemicals, explosives, buoyant materials,
flammable Liquids or other toxic materials
which could be hazardous to public health,
safety, and welfare in a manner in which will
assure that the facilities are situated at
elevations above the height associated with
the regulatory protection elevation or are
adequately floodproofed to prevent flotation
of storage containers, or damage to storage
containers which could result in the escape
of toxic materials into floodwaters.

(d) Regulatory flood (also herein referred to as 100--
year flood) means the level of flooding that, on
the average, is likely to be equaled or exceeded
once in any 100-year period (i.e., that has a one
per cent chance of occuring in any year). For
purposes of this chapter the regulatory shall be
that elevation as established by the Federal
Insurance Administration, 100-year flood standard
as published on the Flood insurance Rate Map (F�RM)
for the city, together with revisions thereto,
which may be made from time to time.
(e) Substantial. improvement means any repair, recon-
struction, or improvement of a structure, the cost
of which equals or exceeds fifty (50) per cent of
the market value of the structure either (a) before
the improvement is started, or (b) if the structure
has been damaged and is being restored, before the
damage occurred.

mobile homes, and manufactured housing. Permits
must_ be obtained for all of the above, and one
issued if th are within a f1o_od�rone area, if
the are_designed to be anchored to event f lots -
tion, coll�a se, and_to resist lateral movement of
the structure resulting from hydrodynamic and
hydrostatic loads including buoyancy.
(g) Accessory building means a secondary residence,
garage, or other building or structure on a lot or
parcel subordinate to and not forming an integral
part of the main or principal building but pertain-
ing to the use of the main building. An accessory
building may include a guest house or servants'
quarters unless prohibited by existing deeds restr-
ictions or any applicable governmental regulation.
(h) Residential. The term "residential" or "residence"
is applied herein to any lot, plot, parcel, tract,
area or piece of land or any building used exclu-
sively for family dwelling purposes or intended to
be so used, including concomitant uses as specified
in Chapter 28 of this Code.
(i) Basement means that portion of a building between
floor and ceiling, which is so located that one-
half or more of the clear height from -floor to
ceiling is below grade.

SECTION 2. That Chapter 10A, Section. 1.OA-2 entitled
"Development in GFH districts --- build-ing permit requirements"
is hereby amended to create a new subsection (1) to read as
follows:
The municipal official responsible for the administra-
tion and enforcement of this chapter shall (to the
extent riot otherwise prohibited by Section 1OA-3) with
respect to development within GFH districts:
(1) Re_ec;uire that all new construction and substantial
improvements that fully enclose areas below the
lowest floor and that are subject to flooding be
designed to automaticall e ualize hydrostatic
flood forces on exterior walls bv allowin for the
entry and exit floodwaters.' Desi ns far meeting
this re uirement must either be certified by a
registered Professional en ineer or _architect or
meet or exceed the following minimum criteria: A
minimum Of two o enin sNhavin a total net area of
not _less than one_ square inch forY

SECTION 3 : Specific authority is hereby granted to
codify Ordinance.
SECTION 4 : All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 5 If any provision of this Ordinance o1.1the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 6 : This Ordinance shall become effective
immediately upon adoption and passage.
