Ord. #� qlv 11 2 A 3 ! 4 5 6 7 8 9 10 11 12 13 14 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-88-�.,3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TAMARAC; PROPOSING AN AMENDMENT TO ARTICLE IV, SECTION 4.02 OF THE CITY CHARTER TO INCREASE THE NUMBER OF SUCCESSIVE ELECTIVE TERMS OF OFFICE PERMITTED UNDER THE CHARTER FROM TWO (2) TERMS TO THREE (3) TERMS FOR COUNCIL MEMBERS AND MAYOR; PROVIDING THAT IF THE PROPOSED AMENDMENT IS APPROVED BY A MAJORITY OF VOTERS AT THE NOVEMBER 8, 1988 : ELECTION THEN SUCH AMENDMENT SHALL BECOME A PART OF THE CITY OF TAMARAC CHARTER UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATIION; PROVIDING FOR REPEALER; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter Board and City Council of the City of Tamarac have suggested amending Article IV, Section 4.02 of the City Charter; and WHEREAS, pursuant to Chapter 166 Florida Statutes a public hearing has been held on this matter; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 That the following proposed amendment to the City Charter shall be presented to the electorate of the City of Tamarac at the November 8, 1988 Election and if the following proposed amendment is approved by a majority of the electorate at said Election, such amendment shall become a part of the City Charter upon certification and acceptance of the election results: 11 M 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 27 28 29 10 31 32 33 34 35 PROPOSED CHARTER AMENDMENT PROPOSED AMENDMENT : An amendment to Article IV, Section 4.02 of the City Charter to increase the number of successive elected terms of office permitted under the Charter from two (2) , two (2 ) year terms to three (3 ) two (2 ) year terms for councilmembers and mayor, thereby permitting a total of six (6) consecutive years in office. Are you in favor of this amendment? Yes No If the proposed Amendment is approved, Article IV, Section 4.02 of the City Charter will read as outlined below. Additions to text are indicated by underscore ; deletions to the text by strikethrough . Sec. 4.02 City council; election, terms and qualifications. Councilmembers shall be elected for a term of two (2) years in the manner provided for and in accordance with the qualifications set forth in Article VI. Councilmembers from odd -numbered districts shall be elected in each odd -numbered year, and councilmembers from even --numbered districts and the mayor shall be elected in each even -numbered year. Beginning with the 1985 1989 municipal election and effective for all elections thereafter, councilmembers (including the mayor) who are elected to office shall not succeed themselves for more than ©rie--ii} two (2) terms , without an intervening term, regardless of the district or seat they might hold; except that if otherwise qualified, the mayor or ex -mayor may run for council and a cennciiman councilmember or ex- eenneilman ex-councilmember may run for mayor. I 2 i 3 4 6rE 0 71 8 -9 10 11 12 13 14 19 20 21 22 23 24 25 26 27 28 29 10 31 32 33 34 35 SECTION 2 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not effect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. SECTION 3 : Specific authority is hereby granted to codify this Ordinance. SECTION 4 All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict.
