Ord. # /4z/T CITY OF TAMARAC, FLORIDA EMERGENCY ORDINANCE No. 0-88--3 7 AN EMERGENCY ORDINANCE AMENDING SECTION 21-11(a) OF THE TAMARAC CODE OF� ORDINANCES; PROVIDING AN ADDITIONAL SIX-MONTH PERIOD BEFORE WHICH CERTAIN NON -CONFORMING SIGNS NOT IN COMPLIANCE WITH CHAPTER 21 OF THE CODE OF ORDINANCES SHALL BE REQUIRED TO COMPLY WITH ALL PROVISIONS OF THAT CHAPTER; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Tamarac City Council, after a series of Public workshops, has determined that the provisions of Chapter 21 relating to signs and advertising within the Tamarac municipal boundaries need to be reexamined and reevaluated in order to promote the stated purposes of Chapter 21 of the Code of Ordinances; and WHEREAS, the deadline for compliance with the require- ments of the ordinance for non -conforming signs is currently established for October 24, 1988; and WHEREAS, the City Council has determined that an emer- gency exists with regard to extending the deadline for compliance with Chapter 21 of the Tamarac Code of Ordinances in order to avoid the imposition of potentially serious civil penalties upon those not in conformance with the terms of an ordinance the City wishes to substantially amend; and WHEREAS, it is impossible to comply with the require- ments of Section 166.041(3)(a), Florida Statutes prior to october 24, 1988: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 The above recited whereas clauses are hereby declared to be true and are fully incorporated herein. SECTION 2 Section 21-11 of the Tamarac Code of Ordinances is hereby amended as follows: Sec. 21-11. Nonconforming Signs (a) Before-6eteber-24-1998-- After A ril 24, 1989 , signs in the City not in conformance with this chapter shall be required to comply with all provisions of this Chapter. SECTION 3 : Specific authority is hereby granted to codify this Ordinance. SECTION 4 All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. -1- s a s� 1 2 3 4 5 j 8 9 10 11 12 13 14 15 16 17 M 20 21 22 23 24 25 26 27 28 29 10 31 33 34 35 SECTION 6 This Ordinance shall become effective immediately upon its enactment by two-thirds of the members of the City Council. Since it is an Emergency Ordinance, you need not comply with the advertising requirements set forth in Sec. 166.041 (3)(a), Florida Statutes. However, you must provide emergency notice to the press and public that the City Council will hold a special meeting on Friday, October 21, 1988 in Conference Room #1 at 2:00 p.m. for the purpose of considering the enactment of the above described emergency ordinance.
