Ord. # 13 9 7 1 2 3 4 5 6 7 8 91 10 11 12 13 14 15 16 17 8 19 20 21 22 23 24 25 26 27 28 29 32 33 34 35 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-88- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TAMARAC; PROPOSING AN AMENDMENT TO ARTICLE VIII, SECTION 8.01(a) OF THE CITY CHARTER TO INCREASE THE NUMBER OF SUCCESSIVE ELECTIVE TERMS OF OFFICE PERMITTED UNDER THE CHARTER FROM TWO (2) TERMS TO THREE (3) TERMS FOR CHARTER BOARD MEMBERS; PROVIDING THAT IF THE PROPOSED AMENDMENT IS APPROVED BY A MAJORITY OF VOTERS AT THE NOVEMBER 8, 1988 ELECTION THEN SUCH AMENDMENT SHALL BECOME A PART OF THE CITY OF TAMARAC CHARTER UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR SEVERABILITY; PROVID- ING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter Board and City Council of the City of Tamarac have suggested amending Article VIII, Section 8.01(a) of the City Charter; and WHEREAS, pursuant to Chapter 166 Florida Statutes a public hearing has been held on this matter; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : That the following amendment to the City Charter shall be presented to the electorate of the City of Tamarac at the November 8, 1988 Election and if the following proposed amendment is approved by a majority of the elector- ate at said Election, such amendment shall become a part of the City Charter upon certification and acceptance of the election results: -1- PROPOSED CHARTER AMENDMENT 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 �z ar 32 33 34 35 PROPOSED AMENDMENT An amendment to Article VIII, Section 8.01(a) to increase the number of successive elected terms of office permitted under the Charter from two (2) two (2) year terms to three (3) two (2) year terms for Charter Board members, thereby permitting a total of six (6) consecutive years in office. Additions to text are indicated by underscore ; deletions by strikethrough . ARTICLE VIII. CHARTER BOARD Sec. 8.01(a) Terms and qualifications (a) Membership. The charter board shall consist of five (5) members. Charter Board members shall be elected for a term of two (2) years in the manner provided _for and _in accordance with the aualifications set forth in article VI. Four (4) members shall reside in different districts, and one (1) member shall run at large. Charter board members from odd -numbered districts and the at -large member shall be elected in each odd -numbered year, and charter board members from even -numbered districts shall be elected in each even - numbered year. Beginning with the 1965 1989 municipal election and effective for all elections thereafter, charter board members who are elected to office shall not succeed themselves for more than enc--i1} two (2) terms without 6rm i= lb 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 8 19 20 21 22 23 24 25 26 27 28 29 10 31 32 33 34 35 any intervening term, regardless of the district or seat they might hold. SECTION 2 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not effect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. SECTION 3 : Specific authority is hereby granted to codify this Ordinance. SECTION 4 : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict.
