Ord. #mow % CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-90- AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA, PROVIDING FOR THE ADOPTION OF THE COMPREHEN- SIVE PLAN FOR THE CITY OF TAMARAC, FLORIDA; PROVIDING FOR FINDINGS OF FACT TO SUPPORT THE ADOPTION OF THE PLAN; PROVIDING FOR ADOPTION OF GOALS, OBJECTIVES, AND POLICIES FOR EACH ELEMENT OF THE COMPREHENSIVE PLAN; PROVIDING FOR ADOPTION OF THE PLAN IMPLEMENTATION PROCEDURES OF THE PLAN; PROVIDING FOR THE ADOPTION OF THE EVALUATING AND MONITORING PROCEDURES OF THE PLAN; PROVIDING FOR THE ACKNOWLEDGEMENT THAT THE SUPPORT DOCUMENT ENTITLED "CITY OF TAMARAC COMPREHENSIVE PLAN: SUPPORT DOCUMENTATION % INCLUDING THE MAP SERIES, EXISTS AND IS AVAILABLE FOR INSPEC TION; PROVIDING FOR SEVERABILITY; AND PROVID- ING AN EFFECTIVE DATE. WHEREAS, the State of Florida has mandated Comprehensive Planning by Florida municipalities in accordance with the Local Comprehensive Planning and Land Development Regulation Act of 1985, as amended; and WHEREAS, the State of Florida has implemented Florida Administrative Code Rule 9J-5 which sets forth comprehensive planning requirements for local governments; and WHEREAS, Broward County is a charter County which requires that the Tamarac Comprehensive Plan be consistent with the Broward County Plan and that certain goals, objectives, and policies as well as implementation language be included in the plan; and WHEREAS, the City of Tamarac is a charter City which has comprehensive planning powers; and WHEREAS, the City wishes to preserve the health, safety, welfare, comfort, good order, appearance, convenience, law enforcement and fire prevention, and general welfare of the residents_-and-cQsporate..cit-zens of the City by adoption of a_ ■ 1 2 3 4 5 6 3; 33 34 I 35 Comprehensive Plan; and WHEREAS, the City wishes to protect and enhance the City's present advantages; and WHEREAS, the City wishes to encourage the most appro- priate use of land, water, and other resources, consistent with the public interest; and WHEREAS, the City wishes to deal effectively with future problems that may result from the use and development of land within the City of Tamarac; WHEREAS, the City of Tamarac wishes to prevent the overcrowding of land and the undue concentration of population; and WHEREAS, the City of Tamarac wishes to facilitate the adequate and efficient provision Of transportation, water, sewerage, schools, parks, recreational facilities, housing, and other requirements and services; and WHEREAS, the City of Tamarac wishes to conserve, develop, utilize and protect natural resources within the City of Tamarac; and WHEREAS, the Comprehensive Plan has been prepared in accordance with the Florida Administrative Code Rule 9J-5 and professional planning practices; and WHEREAS, the Comprehensive Plan is based on data, facts, estimates and projections in the City of Tamarac Comprehensive Plan; and WHEREAS, the City of Tamarac Planning Commission as the Local Planning Agency held a hearing on September 21, 1989 - end en� eu-tie entire -Comprehensive Plan; and — - WHEREAS, a public hearing concerning the entire Compre- hensive Plan has been held by the City Council of the City of iv, 1990_ Tamarac onA=��Clp ursuant to Chapter 163, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac deter- mines that it is in the public interest to adopt the follow- ing Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : That the above -mentioned whereas clauses are incorporated into this Ordinance as findings of fact. SECTION 2 : The City of Tamarac hereby adopts the City of Tamarac Comprehensive Plan 1989 - 1994; including all the Elements of the Comprehensive Plan, the Plan Implementation Procedures and the Evaluating and Monitoring Procedures. A copy of the City of Tamarac Comprehensive Plan 1989 - 1994 is attached hereto as Exhibit "A". SECTION 3 : The adoption of this Comprehensive Plan provides for the preparation and future adoption of a Land Development Code; SECTION 4 : The adoption of this Comprehensive Plan includes the adoption of the Future Land Use Map and provides for the preparation of an updated Zoning Map or other similar implementing document. The map series included in the Comprehensive Plan are hereby adopted as part of this Compre- hensive Plan. SECTION 5 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invali.di,ty._s1jp11 not affect other provisions or 1 Z 3 4 5 6 F= 34 35 applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
