Ord. #1475 1 9 10 '3 t4 25 26 27 29 �0 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-90- T i AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY FROM S-1 (OPEN SPACE / RECREATION), M-2 ( MEDIUM INDUSTRIAL), B-2 (PLANNED BUSINESS), R--3U (ROWHOUSES) , AND R-3 (GARDEN APARTMENTS) TO B-3 (GENERAL BUSINESS), TO CONFORM TO THE CITY LAND USE PLAN, BROWARD COUNTY LAND USE PLAN AND MASTER PLAN OF WESTPOINT DRI; (OTHERWISE IDENTIFIED AS BEING CERTAIN LANDS IN THE SOUTH ONE-HALF OF LAND SECTION 7 - NORTH COMMERCIAL BOULEVARD AND BETWEEN NOB HILL ROAD AND THE SAWGRASS EXPRESSWAY) PETITION #45-Z-89i PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR'SEVERABILITYi AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the zoning of the property described herein and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and WHEREAS, the Council has examined and investigated the request for the zoning herein and has received the recommends- tion of the Planning Commission of the City of Tamarac; and WHEREAS, public hearing has been held on Petition #45-Z-89 by by the City Council, pursuant to the Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That those lands described in Exhibit "A" attached hereto and made a part hereof are hereby rezoned from S-1 (Open Spa,_ /Recreation), M-2 (Medium Industrial), B-2 (PLanned Business); R-3U (Rowhouses), and R-3 (Garden Apartments) to B-3 (General Business), to conform to the City Land Use Plan, Broward County Land Use Plan and Master Plan of Westpoint DRI; SECTION 2: That the Official Zoning Map of the City of Tamarac shall be changed to reflect such zoning, said changes to be initialed by the Mayor and the City Clerk, together with the effel-*ive date of this Ordinances. 1 1I 2 3 4 5 2 3 4 5 6 7 '1 Temp.Ord.#1475 SECTION 3: All Ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
