Ord. #1473 CITY OF TAMARAC, FLORIDA 2 3 4 5 x r� 9 �0 22 23 24 25 26 27 29 30 31 3J 34 35 ORDINANCE NO. 0-90- 6 AN ORDINANCE VACATING ALL OF NW 76 STREET (50-FOOT RIGHT --OF WAY) AND NW 87 WAY (50 FOOT RIGHT-OF-WAY); LESS THE WESTERLY 12 FEET OF NW 76 STREET LYING ADJACENT TO AND CONTIGUOUS WITH THE EASTERLY RIGHT-OF-WAY LINE OF PINE ISLAND ROAD; TOGETHER WITH THE 24-FOOT EMERGENCY ACCESS EASEMENT; TOGETHER WITH THAT CERTAIN 10--FOOT UTILITY AND DRAINAGE EASEMENT LYING ADJACENT TO THE NORTH AND EAST RIGHT-OF- WAY LINE OF THE ABOVE REFERENCED NW 76 STREET AND NW 87 WAY; TOGETHER WITH ALL OF THAT CERTAIN 10-FOOT UTILITY AND DRAINAGE EASEMENT LYING ADJACENT TO THE SOUTH AND WEST RIGHT-OF-WAY LINE OF THE ABOVE REFERENCED NW 76 STREET AND NW 87 WAY, AS SHOWN ON THE WOODMONT TRACT 67 PLAT; AS RECORDED IN PLAT BOOK 118, PAGE 22 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA. SECTION 1: FINDINGS OF FACT A determination is hereby made by the City Council that all of NW 76 Street (50-foot right - of --way) and NW 87 Way (50 foot right--of-way); less the westerly 12 feet of NW 76 Street lying adjacent to and contiguous with the easterly right--of-way line of Pine Island Road; together with the 24-foot emergency access easement, together with that certain 10 foot utility and drainage easement lying adjacent to the north and east right-of-way line of the above referenced NW 76 Street and NW 87 Way, together with all of that certain 10-foot utility and drainage easement lying adjacent to the south and west right -of way line of the above referenced NW 76 'Street and NW 87 Way; as shown on the Woodmont Tract 67 Plat, more particularly described in Exhibit "A" attached hereto, is no longer needed for public purposes and, accordingly, interest should revert to Lhe private party(ies) owning the property burdened by the portions of property to be vacated. SECTION 2: That the properties described in Exhibit "A" attached hereto and made a part hereof are hereby abandonec_, vacated and extinguished by the City Council of the City of Tamarac, Florida, and shall no longer be deemed property to be used for public purposes on behalf of the people of the City of Tamarac, Florida. l 1 1 2 3 4 5 or I 13 14 i5 16 17 1B 22 23 24 25 26 27 17 30 31 ■34 1 ■35' Temp. Ord. #1473 SECTION 3: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
