Ord. #1478 Revised 2/28/90 Revised 3/14/90 1 2 3 t 7 8 9 10 11 12 13 14 15 16 17 1 49 20 21 22 23 24 25 26 27 28 29 z0 1 32 33 34 35 36 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-90- 7 AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 19 "SOLID WASTE" OF THE TAMARAC CITY CODE BY REPEALING THE EXISTING SECTION 19-3 "DISPOSAL OF NEWSPAPERS, CARDBOARD BOXES" AND BY ADDING A NEW SECTION 19-3 ENTITLED "COLLECTION OF RECYCLABLE WASTE"; TO REQUIRE THAT ALL SINGLE-FAMILY RESIDENCES AND RESIDENTIAL UNITS USING CURBSIDE REFUSE SERVICE -SEGREGATE NEWSPAPERS FROM ALL OTHER SOLID WASTE MATERIALS; PROHIBITING THE THEFT OF ANY NEWSPAPER MATERIAL DESIGNATED AS RECYCLABLE BY THE CITYi PROVIDING FOR PENALTIES FOR VIOLATION OF THIS ORDINANCE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Tamarac is mandated to comply with the State of Florida's Solid Waste Act of 1988, and in particular the implementation and operation of a recycling program of certain recyclable materials; and WHEREAS, the City of Tamarac has adopted a policy of developing a Joint Recycling Program which includes the cities of Coconut Creek, Lauderhill, Margate, North Lauderdale and Tamarac to implement the requirements of the Solid Waste Act of 1988; and WHEREAS, the Joint Recycling group cities has decided that the first phase of implementing the requirements of the Solid Waste Act will include the recycling of newspapers in single-family residences to be collected and recycled by a separate contractor; and WHEREAS, the cost to single-family home owners to provide the newspaper recycling program is dependent upon participation rates, the City Council of the City of Tamarac deems it to be in the best interests of all City residents to Temp. Newspaper. Collection -- Newspaper (which for the purposes of this Chapter shall be considered a periodical usually daily or weekly printed on "newsprint") shall be segregated from all other solid waste material by all single family homeowners and residential units using curbside refuse service. It shall be securely bundled with string or twine or placed in a paper -grocery bag_or like__ disposable containers and _placed _ out for collection according to a scheduled day established by the City along with all other refuse at curbside or next to the refuse container used „by such solid waste customers. Newspapers shall not be vlaced in plastic bags nor mixed with magazines, telephone directories, cardboard, shiny advertising print or inserts. Adequate precaution shall be made to ,,�revent newspapers from being scattered by the elements. Temp. SECTION 5 : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
