ORDINANCE NO. 0-90- 9
AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA,
AMENDING THE TAMARAC CITY CODE BY ADDING TO
CHAPTER 24, ARTICLE II ENTITLED "ADMINISTRATION"
A NEW DIVISION 5 ESTABLISHING A LAND DEVELOPMENT
REGULATORY COMMISSION IN SECTION 24-84 AND
PROVIDING FOR ITS DUTIES AND RESPONSIBILITIES IN
SECTION 24-85; PROVIDING FOR CODIFICATION
PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac has prepared and will adopt
its Comprehensive Plan pursuant to part II F.S. 163; and
WHEREAS the City of Tamarac'has adopted Land Development
Regulations which implement its Comprehensive Plan; and
WHEREAS, the Local Government Planning and Land
Development Regulation Act of 1985, as amended, requires
local governments to establish a Land Development Regulatory
Commission;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: A new Division 5 is hereby added to Chapter
24, Article II "Administration" which shall read as follows:
Division 5 Land Development Regulatory Commission
SECTION 24-84: A Land Development Regulatory
Commission as provided for in Section 163.3164(21) F.S. is
hereby established. The members of the Commission shall be
those serving as the Local Planning Agency.
SECTION 24-85: The Land Development Regulatory
Commission shall have the following duties and
responsibilites:
1. Develop and recommend to the local governing body,
land development regulations which implement the adopted
comprehensive plan. Such recommendations are to be made
within two months of the reference by the City Council, or
other agency; and
2. Review land development regulations or amendments
thereto for consistency with the adopted plan, or element or
portion thereof; and

3. Report to the City Council and to the Local
Planning Agency its findings. The Commission shall meet from
time to time in order to discharge these duties.
SECTION 2: Specific authority is hereby granted to
codify this ordinance.
SECTION 3: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and to this end
the provisions of this Ordinance declared to be severable.
SECTION 4: This Ordinance shall become effective
immediately upon adoption and passage.
