Ord. # 1479 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-90-_z2_ AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC ENTITLED "PENSIONS AND RETIREMENT" BY AMENDING SECTION 16--56(d) TO PERMIT ELECTED ALTERNATE PLAN TRUSTEES TO SERVE THE UNEXPIRED TERM OF ELECTED TRUSTEES WHO RESIGN, ARE REMOVED, ARE NO LONGER ELIGIBLE OR QUALIFIED TO SERVE, DIE, OR BECOME INCAPACITATED; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the pension plan establishing the City of Tamarac Employees' Pension Trust Fund now provides that a new election must be held if an elected _trustee is unable to complete his or her term of office as a trustee; and WHEREAS, there is an alternate trustee for each such trustee who, in the opinion of the Pension Board and the City Council, is able to fill out the unexpired term of such a departing regular trustee; and .%- WHEREAS, the City Council of the City of Tamarac determines that it is in the public interest to adopt the following Ordinance; and WHEREAS, the following amendments have been approved by the Board of Trustees of the City of Tamarac Pension Trust Fund; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Section 16-56(d) of the Code of Ordinances of the City of Tamarac is hereby amended to read as follows: -1- Sec. 16-56(d). Members. (d) A vacancy shall occur whenever a trustee resigns, is removed by the appointing official, is no longer eligible or qualified to serve as a trustee, dies or becomes incapacitated. 'Phe---vaenncp-shell-be filled-ice-the-same-merner-es-Nes-utilized-te-s�eleet the- eriginei-trustee: The vacancy_ in_ the office of an appointed trustee shall be filled by a new appointment being made by the City official who appointed the departing trustee. The vacancy in the office of an elected trustee shall be f it ed b the alternate trustee elected by the group of employees who elected the departing trustee. The alternate trustee shall serve out .the unexpired term of the departed trustee. An election shall be held to replace the alternate trustee. The alternate trustee 4*Po elected shall serve out the unwired term of the prior alternate trustee. SECTION 3: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. -2- 1 Z 3 5 6 SECTION 4: This Ordinance shall become effective immediately upon adoption and passage.
