Ord. 1458 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-90--LZZ- AN ORDINANCE OF THE CITY OF TAMARAC AMENDING CHAPTER 24, ARTICLE V, ENTITLED "OFF-STREET PARKING AND LOADING"; AMENDING SECTION 24-576, BY CREATING SUB PARAGRAPHS (h), (i), AND (j) ESTABLISHING PERMITTED AND PROHIBITED OFF-STREET PARKING USES; PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING A EFFECTIVE DATE. wHEREAS, the City of Tamarac wishes to eliminate the parking of commercial vehicles in the public right of way, the use of required parking spaces as an area for repair of vehicles, and the parking of commercial vehicles in such a way that they cause an obstruction of view and therefore become a public safety hazard; and WHEREAS, the City Council of the City of Tamarac has determined it is in the public interest to adopt the following Ordinance; and WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : That Article V, Off Street Parking and Loading, Section 24-576 of Chapter 24 is hereby amended to create new sub -paragraphs (h), (i) and (j) which shall read as follows: Sec. 24-576 Off street parking required. h Permitted itted Parking : All parking spaces required by this Chapter and all supplemental parking_(parking facilities provided but not required) may be used for the intermittent parking of the licensed vehicles of em to ees, occupants, owners, tenants or customers utilizing the building. jil Prohibited parking. Parking of a vehicle which, due to its size, shape, contents or location creates an obstruction or safety hazard, or which cannot be contained within a single parking s ace. JAI Parking in commercial districts of commercial vehicles which are owned, o erated or used in, at, or from the permitted business use when that parkin2 is located: a in the street front or street side, or side interior parkin -if rear yard parking is rovided on the ap2roved site Rlan; or b within 301, exclusive of ..required landscape buffer areas, of any street front or side street or side interior property lines, or c within 10 feet of the rear property lines, if vehicle exceeds 6 feet in height, and the property abuts any residential, community facility, institutional or recreational parcel except that if visually impenetrable buffers (landscape or permitted walls of sufficient height are provided along the property line, this does _not .apply. Definitions as used in this Section: Intermit (1 ) tent Parking_- The periodic parking ,of , .- . _ licensed vehicles of employees, occupants, owners, tenants or customers utilizin a commercial building.during business hours not to exceed a period of 24 hours). (2) Temporary Permit - A permit for a special event festival, carnival etc. issued by the Tamarac Building Department and Community Development Department. -2- (3) Commercial vehicle -Any vehicle used in the operation of a business. SECTION 2 : Specific authority is hereby granted to codify this Ordinance. SECTION 3 : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4 If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
