Ord. #1470 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-90-- AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA AMENDING CHAPTER 24 OF THE CODE OF ORDINANCES; DIVISION 23, LI-1, LIGHT INDUSTRIAL DISTRICT; AMENDING SECTION 24-523, PERMITTED USES, TO DELETE CERTAIN PERMITTED USES AND TO ADD CERTAIN PERMITTED USES; AMENDING SECTION 24- 524 TO DELETE CERTAIN PROHIBITED USES AND TO ADD CERTAIN PROHIBITED USES; PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Tamarac wishes to delete certain uses and add certain uses to section 24-523 which lists the permitted uses for the LI-1 Industrial District; and WHEREAS, the City of Tamarac wishes to delete certain uses and to add certain uses to section 24-524 which lists the prohibited uses for the LI-1 Industrial District; and WHEREAS, the City Council of the City of Tamarac has determined that it is in the public interest to adopt the following Ordinance; and WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : That Section 24-523 of the Code of Ordinances of the City of Tamarac entitled "Permitted Uses" is hereby amended to read as follows: ki I Sec. 24-523. Transportation and community facilities. ,Ancillary commercial uses within buildings devoted to primary industrial uses. r K Heavy commercial uses including new and used 3 automobile, truck, motorcycle, boat and trailer 2 display, sales, and service; newspaper, magazine, 3 and printing plants; bakeries, carpentry,_ cabinet 4 sho s and other trade shops; motion picture S studios; ice houses; building supplies;_ construc- 6. equipment; machinery; monuments; restaur- ant and hotel S2221ies and equipment; ship chand- lery; swimming pool supplies; welding eq2ipment and supplies- 0 (9) Restaurants for the primary use of the employees in 1 the industrial area. 3 (10) Accessory uses and structures. 3 (11) Other commercial and retail business uses and 4 hotel, motel and similar lodgings under the condit- 5 ions specified in the Hroward County Land Use Plan 6 and the certified City Land Use Plan. 7 SECTION 2 : That section 24-524 of the Code of Ordinances of the City of Tamarac entitled "Prohibited Uses" is hereby amended to read as follows: Sec. 24-524. Prohibited Uses. 3 The permissible uses enumerated in section 24-523 2 shall not be construed to include either as a principal or 3 accessory use, any of the following. It 33 34 35 Smelting or refining of ores or metal. Landfills, resource recovery facilities,transfer stations, --relay--statieas ---and--pewer--plants= electrical generating plants; and electric utility sub -stations. SECTION 3 : Specific authority is hereby granted to codify this Ordinance. SECTION 4 : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
