CITY OF TAMARAC, FLORIDA
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA,
AMENDING CHAPTER 9, "HEALTH, SANITATION, AND
NUISANCES", ARTICLE II, "SANITARY KUISANCES",
DIVISION II, "CONDITION OF PREMISES
GENERALLY" BY ADDING DEFINITIONS APPLICABLE
TO SECTIONS 9-37, 9-39, 9-40, AND 9-41;
ADDING A PROVISION TO SECTION 9-37 REQUIRING
REPAIR OR REPLAC 2TT OF PAVED AREAS WHEN
ROADROCK OR SUBBASE IS VISIBLE; COMPLETELY
REVISING SECTION 9-41, ESTABLISHING STANDARDS
FOR THE EXTERIOR OF BUILDINGS IN THE CITY OF
TAMARAC; PROVIDING FOR A REPEALER; PROVIDING
FOR INCLUSION IN THE CODE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City Council, of the City of Tamarac finds that
it is in the best interests of the health, safety, and welfare of
the citizens of the City of Tamarac to provide specific standards
for the maintenance of property and paved areas within the City
of Tamarac, and that the lack thereof has created a problem for
the Code Enforcement Department, and Code Enforcement Board of
the City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
That section 9-36 of the City Code, "Applicability", is
hereby amended by adding thereto a new section (c), adding
definitions for the following words and phrases, which shall read

That section 9-37 of the City Code, "Paved areas", is hereby
amended by adding thereto the following words -and phrases which
are underscored, and deleting therefrom the following words and

phrases which are struck through, as follows:
Sec. 9-37. Paved areas.
It shall be the responsibility of all
persons included in the provisions of section
9-36 to maintain all paved areas in a neat
and clean condition,,:-free-ef- brash debris,

including but not limited to parking areas
and ingress or egress driveways.

That section 9-41 of the City Code, "Building exteriors", i
hereby amended by adding thereto the following words and phrases
which are underscored and deleting therefrom the following words
and phrases which are struck through, as follows:

Should any section or provision of this Ordinance, or any
portion thereof, or any sentence, paragraph or word be declared
by a Court of competent jurisdiction to be invalid, such decision
• `shall not affect the validity of the remainder hereof, as a whole
or a part hereof, other than the part declared to be invalid.
All sections or parts of sections of the Code of Municipal
Ordinances, all ordinances or parts of ordinances and all
resolutions or parts of resolutions in conflict herewith, be and
the same, are hereby repealed to the extent of such conflict.
It is the intention of the City Council of the City of
Tamarac that the provisions of this Ordinance shall become and be
made a part of the Code of ordinances of the City of Tamarac and

that the sections of this Ordinance may be renumbered or
relettered and the word "Ordinance" may be changed to "Chapter",
"Section", "Article", or such other appropriate word or phrase,
the use of which shall accomplish the intentions hereir
expressed.
Section 7.
This Ordinance shall be in full force and take effect
immediately upon its passage and adoption.
