AN ORDINANCE OF THE CITY OF TAMARAC' FLORIDA, AMENDING CHAPTER 6, "FINANCE AND TAXATION", ARTICLE .II, "FEES AND. FUNDS"., SECTION 6--31• . "INSUFFICIENT FUNDSt REIMBURSEMENT , FOR OVERDRAFT CHARGESt ADMINISTRATIVE FEE", TO PROVIDE FOR A $15.00 OR FIVE (5) PERCENT OF THE FACE VALUE ADMINISTRATIVE FEEL PROVIDING FOR CODIFICA- TIONt PROVIDING FOR REPEALER, PROVIDING. FOR SEVERABILITYt AND PROVIDING AN. EFFECTIVE DATE, WHEREAS, Florida Statute Subsection 166.251 provides that a municipality may adopt a service fee up to $15.00 or five (5) percent of the face amount of the check, draft, or order, whichever is greater, for the collection of a dishonored check, draft, or other order for the payment of money to a municipal agencyt and. WHEREAS, Tamarac Code Section 6-31 provides for an administrative fee for the processing of an unpaid check or order of $10.00 or five (5) percent of. the face value of the check -or order, whichever is greater, up to a maximum of $25.001 and WHEREAS, the Council of the City of Tamarac wishes to amend Code Section 6-31•to conform with Florida Statute Subsection 166.251, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Code of Ordinances of the City of Tamarac, Florida, Chapter 6, "Finance and Taxation", Article II, "Fees and Funds", 6ection' 6-31 "Insufficient fundst reimbursement for overdraft . charges= administrative fee" is amended to read as follows: 01 Sec. 6--31. Insufficient fundst reimbursement for overdraft chargest administrative fee. If a check, draft or other order for the payment of money is returned to the city unpaid by a bank or lending institution, then the-efty-eha*#-net-eeeept--payment-en--sneh seeeunt-wfthent-receiving-interest-in-seeer'denee-with-Seetien 6-39s IP the city shall also receive reimbursement for all overdraft.charges assessed to the city by the bank or lending Institution, plus an administrative fee for the processing of the unpaid check or order of ten--dei&srs-46lGv99} -fifteen dollars_ ,($15.00) or five (5) percent of the face value amount of the checkt_ draft'or order, whichever is greater i%p-te--a s►axfattien-ef-twenty_ fire-de��ars�-�633: B9}. SECTION 2s Specific authority is hereby granted to codify this Ordinance. SECTION 3s All ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4s If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications bf this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
