Ord. #1980 — Rev. 6 — September 20, 2002 September 25, 2002 Page 1 1� CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2002-21 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AMENDING CHAPTER 10, ARTICLE V, DIVISION 5 ENTITLED "WATERWAYS AND MARINE STRUCTURES", SECTION 10-232, ENTITLED "BULKHEADS, DESIGN STANDARDS"; PROVIDING FOR THE ESTABLISHMENT OF AN ALTERNATIVE TO PRECAST CONCRETE PANELS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, section 10-232(a) of the City Code requires that all seawalls be constructed of precast concrete panels; and WHEREAS, the construction of precast concrete seawalls involves the use of heavy equipment requiring ample room for access; and WHEREAS, certain locations within the City of Tamarac do not have sufficient room between houses to provide access for heavy equipment; and WHEREAS, certain subdivisions within the City of Tamarac have seawalls made of materials other than precast concrete panels; and WHEREAS, the City of Tamarac finds that there is a need to grant relief to property owners when situations arise that make the installation of precast concrete panel seawalls impossible or impractical to adhere to; and WHEREAS, the Director of Public Works and the Director of Community Development recommend approval of this ordinance providing for alternate materials for reconstruction of seawalls; and C;0DING: Words'n s'r "' '' �, are deletions from exiting law, Words in underscored type are additions. Ord. #1980 — Rev. 6 — September 20, 2002 September 25, 2002 Page 2 WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 10, Article V, Division 5 entitled "Waterways and Marine Structures", Section 10-232, entitled "Bulkheads; design standards"; providing for the establishment of an alternative to precast concrete panels. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof, SECTION 2: Chapter 10, Article V, Division 5, Section 10-232 of the Code of Ordinances is hereby amended as follows: Sec. 10--232. Bulkheads; design standards. a Pre-castPortland cement concreteanels 1� Bulkheads or seawalls shall be precast, portland cement concrete panels constructed of four thousand (4,000) psi concrete, reinforced with forty thousand (40,000) psi yield point structural grade steel and design in accordance with Ordinance No. 76-24, as amended from time to time. 4�) 2) Minimum elevations for the top of caps shall be the same as those required for street crowns as enumerated in section 10-187. �G4 3) The precast bulkhead slab shall extend at least nine (9) inches into soil or four (4) inches into rock at bottom. If hard rock is encountered, W4 X 18 stringers may be cast into the piles to penetrate into the rock and provide sufficient anchorage. {e) 5 Tieback rods of adequate size shall be coated with two (2) layers of bituminous paint and wrapped to prevent corrosion. b Alternate design standards 1) In cases where admacent seawalls are not constructed of precast concrete panels in conformance with section 10-232 a or in cases where site constraints make the installation of precast concrete seawalls impossible or impractical, alternate design methods and construction materials may be submitted to the City Engineer for consideration. a. Planning,design and inspection of seawall structures shall be performed by a Professional Structural Engineer registered in the State of Florida in accordance with applicable codes. b. Alternate designs and materials must be approved by the City Engineer as to compliance with section 10-232 cprior to the issuance of a permit. c. Prior to the approval of alternate designs and materials the Director of Community Development shall review the aesthetics and continuity of seawall as compared to the admoining properties and surrounding communities. 2) Alternate design standards are not applicable to new developments, which shall conform to section 10-232(a). c) General standards 4) 1) The face water -side of the bulkhead shall coincide with the development's property line. Any excavation required from the property line to midstream shall be the responsibility of the permittee. An engineer registered in the State of Florida shall submit the proposed layout of the bulkhead system of six (6) sets of certified plans and specifications showing complete details of the seawall, pertinent topographical and soils information, structural calculations and a complete unit cost breakdown. ?)_The city assumes no liability for the design or construction of bulkheads, and their adequacy is and remains the responsibility of the design professional who certifies the plans, specifications and structural calculations. Ord. #1980 — Rev. 6 — September 20, 2002 September 25, 2002 Page 4 fig} Maintenance of bulkheads, after final approval, shall be the responsibility of the contiguous property owner and becomes the responsibility of the city only where such construction lies within the dedicated street right-of- way. No modifications, removal, or additions shall be made to any bulkhead or seawall without prior approval of plans and issuance of a permit by the city. SECTION 3. It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4, All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. This Ordinance shall become effective immediately upon its passage and adoption.
