ORDINANCE NO. 0-2002 J6,
AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, AMENDING
CHAPTER 12, "LICENSE AND BUSINESS
REGULATIONS", ARTICLE II, "OCCUPATIONAL
LICENSES", SECTION 12-39, "AMOUNT OF FEE" OF
THE CITY OF TAMARAC CODE OF ORDINANCES BY
MODIFYING CERTAIN OCCUPATIONAL LICENSE
CLASSIFICATIONS TO CONFORM WITH CHAPTER
205, FLORIDA STATUTES AND TO CONFORM WITH
CLASSIFICATIONS THAT ARE COMMONLY USED
AND CURRENTLY INCLUDED IN THE CITY'S HTE
OCCUPATIONAL LICENSING SYSTEM, AND TO
CLARIFY THE MEANING OF THE CATEGORY
"ACCESSORY USE" (CASE NO. 23-Z-02);
PROVIDING FOR CODIFICATION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac desires to conform its
occupational license Ordinance with Chapter 205, Florida Statutes; and
WHEREAS, upon review of Chapter 12 of the City's Code of Ordinances, it was
found that several commonly used classifications/categories that are currently in the City's
HTE occupational licensing system are not in the City"s Cade; and
WHEREAS, it is desirous to reflect these commonly used classifications/categories
within the City's Code; and

WHEREAS, it is beneficial to the business customer's understanding of the
category, "accessory use", to include a further description of this classification; and
WHEREAS, the Director of Community Development recommends approvalo and
WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the
best interest of the citizens and residents of the City of Tamarac to amend Chapter 12,
"License and Business Regulations", Article 11, "Occupational Licenses", Section 12-39,
"Amount of Fee" of the City of Tamarac Code of Ordinances by modifying certain
occupational license classifications to conform with Chapter 205, Florida Statutes and to
conform with classifications that are commonly used and currently included in the City's
HTE occupational licensing system, and to clarify the meaning of the category "accessory
use"
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF'
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of the Ordinance
upon adoption hereof.
SECTION 2: Chapter 12„ Article II, "Occupational Licenses", Section 12-39,
"Amount of Fee", is hereby amended as follows:

Licenses shall be issued to cover but one (1) location and but one (1) of the
occupations of business classifications hereinafter set out unless permitted hereunder
and the amounts assessed as license fees against the various trades, businesses and
professions are hereby fixed as follows:

period is presumed to be a motor
vehicle dealer and must have an
appropriate license issued by the State).
(In Florida, automobile dealers are
licensed and regulated by the
Division of Motor Vehicles under
Section 320,27, Florida Statutes).
(There are four (4) classes of licenses
issued to motor vehicle dealers. They are:)
1) INDEPENDENT DEALER -for a person dealing
In used cars only. This license permits the
licenses to transact business either retail
or wholesale.
2) FRANCHISE DEALER --allows the licensee to
sell new cars under an agreement with a
manufacturer.
3) WHOLESALE DEALER -licensees may only buy
from, sell to and deal wholesale with other
licensed dealers.
4) AUCTIONS -are licensed to sell, on behalf of
licensed dealers, by the bid process. Auctions
may not sell at retail.

SECTION 3: It is the intention of the City Commission and it is
hereby ordained that the provisions of this Ordinance shall become and be made a part
of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this
Ordinance may be renumbered, relettered and the word "Ordinance" may be changed
to "Section", "Article" or such other word or phrase in order to accomplish such
intention.
SECTION 4: All Ordinances or parts of Ordinances, and all
Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the
extent of such conflict.
SECTION 5�, If any provision of this Ordinance or, the application
thereof to any person or, circumstance is held invalid, such invalidity shall not affect
other provisions or applications of this Ordinance that can be given affect without the
invalid provision or application, and to this end the provisions of this Ordinance are
declared to be severable.
