Ord. #1974 -- August 6, 2002 Revision No. 1 -- September 12, 2002 Revision No. 2 -- September 24, 2002 Revision No. 3 — October 3, 2002 Revision No. 4 — October 18, 2002 Revision No. 5 — October 29, 2002 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2002- ;�; `t AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 10 ENTITLED, "LAND DEVELOPMENT REGULATIONS", ARTICLE V ENTITLED, "IMPROVEMENTS", DIVISION I ENTITLED, "GENERALLY", SECTION 10-154 ENTITLED, "ENGINEERING PLANS AND SPECIFICATIONS" BY AMENDING THE REGULATIONS, REQUIREMENTS AND PROCEDURE BY WHICH FINAL ENGINEERING PLANS AND SPECIFICATIONS ARE SUBMITTED AND TO ALLOW FOR SUBMITTAL AND APPROVAL OF PLANS AND SPECIFICATIONS THAT INCLUDE DRAINAGE, WATER SUPPLY, SEWAGE COLLECTION AND ANY OTHER INFORMATION DEEMED NECESSARY BY THE CITY ENGINEER PRIOR TO THE ISSUANCE OF BUILDING PERMITS (CASE NO. 19-Z-02); PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac realizes the delays in processing site plans due to the requirement that all final engineering plans, et.al. be submitted to the City Engineer for review and approval after final site plan review by the Planning Board and prior to the submittal of the final plat or final site development plan to the City Commission; and CODING: Words in str�jek ," 0 type are deletions from existing law; Words in underscored type are additions. Ord. #1974 -- August 6, 2002 Revision No. 1 — September 12, 2002 Revision No. 2 — September 24, 2002 Revision No. 3 — October 3, 2002 Revision No. 4 — October 18, 2002 Revision No. 5 — October 29, 2002 Page 2 WHEREAS, the City Commission of the City of Tamarac realizes there are delays in processing site plans due to the requirement that engineering plans be submitted to the City Engineer prior to City Commission approval; and WHEREAS, the City Commission of the City of Tamarac has determined that all engineering plans, including drainage, water supply, sewage collection and any other information deemed necessary by the City Engineer shall be reviewed and approved by the City Engineer prior to the issuance of building permits; and WHEREAS, the City Commission of the City of Tamarac has determined that based upon the research and findings of City staff, the proposed amendments to the regulations and requirements for submission of engineering plans and specifications will expedite the development review process; and WHEREAS, the Director of Community Development recommends approval to amend the regulations and requirements for engineering plans and specifications-, and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 10 entitled, "Land Development Regulations", Article V entitled, "Improvements", Section 10- 154 entitled, "Engineering Plans and Specifications" by amending the regulations, requirements and procedure by which final engineering plans and specifications are CODING: Words in 4H4 k-4JRet.9b type are deletions from existing law, Words in underscored type are additions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE. CITY OF TAMARAC, FLORIDA- SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: That Chapter 10 entitled, "Land Development Regulations", Article V entitled, "Improvements", Division I, "Generally", Section 10-154 entitled, "Engineering plans and specifications", is hereby amended to read as follows: Sec. 10-154. Engineering plans and specifications. (a) All final engineering plans for public and private paving and drainage improvements, including but not limited to canal or lake excavation, dredging, bulkheads, bridges, culverts, headwalls, endwalls, earthwork (cut or fill), grading, paving (including subgrade preparation, base and surface), sidewalks, curbs and gutters, median crossings, guardrails, street signs, CODING: Words in StFHGI<thro type are deletions from existing law; Words in underscored type are additions. (sjJ The work of clearing and grubbing may occur on any land, whether a site plan is required or not, after the permit for such work has been obtained from the city engineer. The issuance of the permit shall not give vested rights to the developer and should the project be denied by the city Go 4 commission, the developer shall remove all disturbed materials and leave the site in a neat condition. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
