Ord. #1985 1 October 16, 2002 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2002- . j/ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 2 OF THE TAMARAC CODE ENTITLED "ADMINISTRATION", ARTICLE V, ENTITLED "CONFLICTS OF INTEREST", SECTION 2-272, ENTITLED "DUTY TO REPORT VIOLATIONS" AND SECTION 2-274, ENTITLED "ENFORCEMENT BY SUIT" BY ELIMINATING REFERENCE TO THE CHARTER BOARD; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on September 10, 2002 the Tamarac electorate approved a referendum question changing the Charter Board from an elected Board to an appointed WHEREAS, the Charter Board is and continues to be an advisory Board to the City Commission; and WHEREAS, the City of Tamarac deems it to be in the best interests of the residents and citizens of the City of Tamarac to amend Sections 2-272 and 2-274 of the City of Tamarac Code by eliminating reference to the Charter Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Ord. #1985 2 October 16, 2002 SECTION 2: That Section 2-272 of the Tamarac Code is amended as follows: Sec. 2-272. Duty to report violations It shall be the duty of every officer or employee of the city who has knowledge of any violations of the provisions of this article to immediately report such violation to the city i4 commission and 4n the charter hnarrl SECTION 3: That Section 2-274 of the Tamarac Code is amended as follows: Sec. 2-274. Enforcement by suit. The city GeunGll commission ^r + 4aAeF_boafd or any resident or group of residents of the city may bring any appropriate suit to compel compliance with the provisions of this article. SECTION 4: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 5: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions CODING: Words in StrYGk through type are deletions from existing law; Words in underscored type are additions. 1 Temp.
