Ord. #1929 Page 1 05/04/01 Revision #1 — 11/20/01 Revision #2 — 11/30/01 Revision #3—12/04/01 CITY OF TAMARAC, FLORIDA 0 ORDINANCE NO. 0-2002-003 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 7, FIRE PREVENTION AND PROTECTION, CREATING SECTION 7-55, OF THE TAMARAC CODE, TO CREATE THE COMMUNITY AUTOMATED EXTERNAL DEFIBRILLATOR PROGRAM; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Tamarac provides Paramedic Advanced Life Support Services to the citizens and visitors of Tamarac through its Emergency Medical Services (hereinafter sometimes referred to as "EMS"); and WHEREAS, the American Heart Association has determined one key way to improving survival rates from sudden cardiac arrest is to reduce the time to deliver defibrillation therapy; and WHEREAS, the American Heart Association reports recent breakthroughs in technology have resulted in the availability of devices known as automated external defibrillators ("AED") which are proven to be safe and effective for use by lay persons with minimal training in rapidly delivering a defibrillatory shock; and CODING: Words in 6tFUGk through type are deletions from existing law; Words in underscored type are additions. Ord. #1929 Page 2 05/04/01 Revision #1—11/20/01 Revision #2 — 11/30/01 Revision #3—12/04/01 WHEREAS, the American Heart Association anticipates the widespread availability of AED's will make sudden cardiac arrest a truly treatable disease and will save lives; and WHEREAS, the Florida Legislature has determined that certain procedures should be implemented to ensure proper use of AED's and has enacted Section 401.2915, Florida Statutes, outlining these procedures; and WHEREAS, it is the intent of this Ordinance to set minimum standards for use, maintenance, training, data collection, and data recovery for the Community Automated External Defibrillator Program; and WHEREAS, the City of Tamarac Fire Rescue Department as licensed providers of pre -hospital care will develop and coordinate this program; and WHEREAS, the Fire Chief recommends the amendment to the City of Tamarac Code of Ordinances to provide for the creation of the Community Automated External Defibrillator Program; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac that the City of CODING: Words in StFUGk thF9Ugh type are deletions from existing law; Words in underscored type are additions. 1 1 1 Temp. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: That the foregoing WHEREAS clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: That the Tamarac Code, Section 7-55, is hereby created to read as follows: Section #7-55: Community Automated External Defibrillator Program TITLE AND CITATION: This Ordinance shall be known and may be cited as the "Community Automated External Defibrillator Program" Ordinance for the City of Tamarac. FINDINGS AND PURPOSE: The City of Tamarac provides ambulance services and emergency medical services through its Fire Rescue Department. Pursuant to Article Vlll of the Constitution of the State of Florida and Section 166.021 Florida Statutes the City of Tamarac has the authority to exercise broad home rule powers and as such finds it is in the best interest of the citizens of Tamarac, Florida to enact this Ordinance. Ord. #1929 Page 4 05/04/01 Revision #1—11/20/01 Revision #2 — 11/30/01 Revision #3—12/04/01 It is the purpose of this Ordinance to create the Community Automated External Defibrillator Program which will establish guidelines for use training, and data collection as well as re uirements and procedures for implementing and using all existing and new Automatic External Defibrillators AED's in the community. APPLICABILITY: Notwithstanding any provisions of anV other citV zoning or other ordinances to the contrary, the Community Automated External Defibrillator Program shall ar)r)lv to and be enforced in the incorporated areas of the City. Hos itals as defined in Section 395.002 13 Florida Statutes are exempt from the provisions of this Ordinance. Requirements and Procedures: The following shall be the requirements and procedures for use training, and data collection of the AED program: (a) No AED shall be used in the incorporated area of the City of Tamarac without first complying with the requirements and procedures set forth in this section. (b) The implementation of an AED may occur only_after a written notification is made to the Fire Chief or his designee by the individual, entity, organization, or company acquiring an AED. The written notification must contain the facility or business name, street address, specific location of the AED the approximate annual number of People who work live at or visit the location facility or business the total number of persons trained or to be trained in the use of the AED's and name of manufacturer, and model number, and description of each AED. Ord. #1929 Page 5 05/04/01 Revision #1 — 11/20/01 Revision #2 — 11/30/01 Revision #3--12/04/01 company will obtain and send to Tamarac Fire Rescue proof of standardized training for all intended users of the AED. The trainin will consist of a class provided by a nationally -recognized organization, or locally-aporoved by the City of Tamarac Fire Rescue Department, including, but not limited to, the American Heart Association, the American Red Cross and the National Safety Council and shall follow a standardized curriculum. The standardized curriculum shall include, at a minimum: (i) signs and symptoms of sudden cardiac arrest (H) cardiopulmonary resuscitation, and (iii) proper use maintenance and inspection of AED's. (d) The owner of the AED will ensure that the use of the AED follows the policies and procedures developed and authorized by the City of Tamarac Fire Rescue Department, and the provision of F.S. Section 401.2915, as may be amended. (e) Recertification of users maintenance and inspection of the AED is the responsibility of the owner and shall be done on a periodic basis as rescribed by the manufacturer and/or certifying agency. Recertification of users will consist of a class which will review the techni ues for using the AED and follow a standardized curriculum. Recertification training shall be provided as in Paragraph c above. Maintenance of the AED device shall be in accordance with the manufacturer's recommendations. (f) Tamarac Fire Rescue may conduct a quality assurance review after use of an AED that includes gathering clinical data and information from the person that used the AED and from the AED itself. Ord. #1929 Page 6 05/04/01 Revision #1—11/20/01 Revision #2 — 11/30/01 Revision #3 — 12/04/01 (g) Any person who uses an AED is re uired to contact Tamarac Fire Rescue by calling 9-1-1 immediately prior to or immediately upon use of the AED F.S. 401.2915). (h) The owner and user of the AED will not withhold consent fora ualit assurance review by Tamarac Fire Rescue after the use of an AED or to the retrieval of clinical data from the device itself. (i) The City of Tamarac Fire Rescue Department may conduct an inspection for the presence of the AED device and may inspect any maintenance records and documentation of training to ensure compliance with the Community Automated External Defibrillator Program. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or re -lettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or CODING: Words in stFUGk thFeHgI4 type are deletions from existing law; Words in underscored type are additions. 1 u 1 Temp. SECTION 6: This Ordinance shall become effective immediately upon its passage and adoption. PASSED, FIRST READING this 12th day of December, 2001.
