Ord. # T01968 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2002-13 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE CREATION OF SAFE NEIGHBORHOOD IMPROVEMENT DISTRICTS PURSUANT TO SECTION 163.501-ET SEQ., FLORIDA STATUTES KNOWN AS THE "SAFE NEIGHBORHOODS ACT" PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Sections 163.501 et seq. of the Florida Statutes established the Safe Neighborhoods Act; and WHEREAS, Section 163.504 of the Safe Neighborhoods Act provides that the governing body of any municipality or county may authorize the formation of safe neighborhood improvement districts through the adoption of a planning ordinance which specifies that such districts may be created by one or more of the methods established in ss. 163.506, 163.508, 163.511, and 163.512; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interests of the citizens and residents of the City of Tamarac to create neighborhood improvement districts in accordance with 163.501 et seq. of the Florida Statutes; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: Safe Neighborhood Improvement Districts as provided by 163.501-et seq., Florida Statutes, may be established within the City of Tamarac. June 12, 2002 - Temp. Ord. # T01968 SECTION 3: The method of establishing such Safe Neighborhood Improvement Districts in the City of Tamarac shall be as described in 163.501 et seq., Florida Statutes. SECTION 4: All Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such provision shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. SECTION 6: This Ordinance shall become effective immediately upon its passage and adoption. PASSED, FIRST READING this 12th day of June, 2002. PASSED, SECOND READING this 261h day of June, 2002.
