ORDINANCE NO. 2012-`
AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 29
"ADMINISTRATION" OF THE CODE OF ORDINANCES
OF THE CITY OF TAMARAC BY ENACTING ARTICLE XII,
"TRAVEL"; ESTABLISHING NEW SECTIONS 2-409
THROUGH 2-4169 TO PROVIDE REGULATIONS
RELATING TO TRAVEL EXPENSES; PROVIDING FOR
CODIFICATION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 112.061 Florida Statutes authorizes a municipality enact a
special law governing travel in a municipality; and
WHEREAS, the City Commission recognizes that it is beneficial to the City to
encourage the employees to enhance their job related skills and capabilities by
attending approved professional functions including, but not limited to, professional
meetings, seminars, training sessions, and conferences ; and
WHEREAS, it is also recognized that it is to the City's and employee's advantage
for the City to finance legitimate and reasonable costs in connection with attendance to
approved professional functions including but not limited to, professional meetings,
seminars, training sessions, and conferences to enhance the employee's job -related
skills and capabilities; and
WHEREAS, the City Commission deems the implementation of a Travel
ordinance to be in the best interests of the health, safety, and welfare of the citizens and
residents of the City of Tamarac.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AS FOLLOWS:
Section 1. The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Ordinance upon adoption hereof.
Section 2. That Chapter 2, entitled "Administration", of the Code of Ordinances
of the City of Tamarac is hereby amended by enacting a new Article XII, Entitled,
"Travel Policy", to read as follows:
ARTICLE XII. TRAVEL
Section 2-409. Intent
The intent of this article is to provide the opportunity for City employees to
enhance their iob related skills and capabilities by financing reasonable
costs associated with professional development as well as expenses
incurred in connection with official City business.
Section 2-410. Purpose
The purpose of this article is to establish uniform rates and methods of
calculations governing reimbursement of travel and related expenditures
and for the proper application for cash advances and/or use of City
credit/procurement cards.
Section 2-411. Applicability
The provisions of this article shall be applicable to all individuals employed
by, the City of Tamarac.
Section 2-412 Definitions
As used in this article, the following words or terms shall have the
meanings indicated:

_ City -Owned Vehicle means transportation provided by a vehicle owned by
the City of Tamarac in lieu of common carrier or privately -owned vehicle.
Common Carrier means long-distance transportation provided by bus,
train or commercial airline. Example: from Fort Lauderdale to New York.
Communications means long distance telephone, telegraph, faxes, and
internet charges incurred for business use.
Commuter Service means local transportation provided by bus, limousine,
taxicab, subway, or other commuter service. Example: from airport to the
hotel.
Conference means a congregation (usually annually) of members of a
-group or association with a common purpose (e.g. similar careers or
responsibilities).
Mileage Allowance means the fixed rate provide by the Internal Revenue
Code, as amended from time to time, per mile for use of a privately -owned
vehicle.
Miscellaneous tips means gratuitous payment to individuals for services
such as baggage handling and valet parking_
Official Business means business performed on behalf of and/or for the
benefit of the City of Tamarac by an employee or commissioner for the
City of Tamarac.
Per Diem means the allowance for lodq ng (excluding taxes), meals and
related incidental expenses as set forth by the United States General
Services Administration.
Privately -Owned Vehicle means transportation provided by the
employee's personal vehicle in lieu of common carrier or City -owned
vehicle.
Professional Development means conferences, seminars, training
courses, workshops or any organized event for the purpose of enhancing
job -related skills and capabilities.
Rental Car means transportation provided by a rental agency.

Seminar means an advanced course often featuring informality and ON--%
discussion.
Training Program means a session designed to instruct or guide an
employee in the development and/or enhancement of a skill or
proficiencies that have generally recognized benefits to the City.
Traveler means a public officer, public employee, or authorized person,
when performing authorized travel.
Travel expense, traveling expenses, necessary expenses while traveling,
actual expenses while traveling or words of similar nature means the
usual, ordinary and incidental expenditures necessarily incurred by a
traveler.
Workshop means a brief intensive educational program for a relatively
small group of people that emphasizes participation in problem solving.
Section 2-413 Travel Expenses
For purposes of reimbursement, the rates and methods of calculations are
subiect to the following:
A. All travelers may be allowed reimbursement for subsistence when
traveling for professional development or to conduct bona fide City
business.
B. The traveler shall select the method of calculating reimbursement, in
writing, prior to the travel. The traveler shall receive reimbursement
based upon either of the following:
1. The per diem dollar amount authorized by the United States
General Services Administration, as amended from time to time; or
2. The amounts permitted by the United States General Services
Administration, as amended from time to time, for meals plus the
following expenses, if applicable: mileage allowance; rental car
expense; commuter service; parking, garage and toll charges;
registration fee and course materials; communications; and
miscellaneous tips to be substantiated by bills paid therefore.

Section 2-414 Travel by Privately -Owned Vehicle
Whenever travel is by privately -owned vehicle, the traveler shall be
entitled to a mileage allowance at the fixed rate provided for by the
Internal Revenue Code, as amended from time to time. This
reimbursement does not apply to employees receiving a monthly auto
allowance or for expenditures related to the operation, maintenance, and
ownership of a vehicle when privately -owned vehicles are used on public
business and reimbursement is made pursuant to this section. However,
for travel outside of tri-county area of Palm Beach, Broward and Miami -
Dade Counties, employees who receive a monthly auto allowance may
receive reimbursement as described herein so long as the travel is in
connection with official City business.
Section 2-416 Non -Reimbursable Expenses
Employees shall not be reimbursed from City funds for any personal
items, alcoholic beverages, entertainment, or any expenses incurred by
quests or members of the employee's family.
Section 2-416 Travel Policy.
A travel policy shall be adopted by Resolution and incorporated in the
City's Administrative Policies in its entirety.
Section 3. It is the intention of the City Commission of the City of Tamarac that
the provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City of Tamarac, Florida, and that the Sections of this ordinance may be
renumbered, re -lettered and the word "Ordinance" may be changed to "Section", "Article"
or such other word or phrase in order to accomplish such intention.
Section 5. If any clause, section, or other part or application of this Ordinance
shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such
unconstitutional or invalid part or application shall be considered as eliminated and so not
affecting the remaining portions or applications remaining in full force and effect.

Section 6. All Ordinances or parts of Ordinances, Resolutions or parts of
Resolutions in conflict herewith be and the same are hereby repealed to the extent of such
conflict.
Section 7. This Ordinance shall become effective on immediately upon adoption,
as provided by Florida law.
