HomeMy WebLinkAboutCity of Tamarac Ordinance O-2012-003Temp Ord. #2239 December 19, 2011 Page 1 of 5 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2012--03 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AMENDING CHAPTER 16, PENSIONS AND RETIREMENT, ARTICLE IX, ELECTED AND APPOINTED OFFICERS AND NON -REPRESENTED EMPLOYEES RETIREMENT PLAN; AMENDING THE DEFINITION OF "COMPENSATION" IN SECTION 16-901 OF THE PLAN TO EXCLUDE OTHER NON-TAXABLE REIMBURSEMENT, LEAVE PAYMENTS OTHER THAN AT SEPARATION AND OVERTIME IN EXCESS OF 300 HOURS PER YEAR; AMENDING SECTION 16- 906(c) AND (e) TO LOWER THE INTEREST PAID ON A RETURN OF EMPLOYEE CONTRIBUTIONS FROM 4 PERCENT TO 2.5 PERCENT; CREATING SECTION 16-906(k) TO ALLOW EMPLOYEES THAT WERE OTHERWISE ELIGIBLE FOR MEMBERSHIP IN THE PLAN BUT CHOSE TO REMAIN IN ANOTHER CITY SPONSORED RETIREMENT PLAN AT THE TIME THE ELECTED AND APPOINTED OFFICERS AND NOW REPRESENTED EMPLOYEES RETIREMENT PLANS WAS ESTABLISHED TO TRANSFER INTO THE PLAN; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Pension Trust Fund Board of Trustees has reviewed the proposed changes; and WHEREAS, the City Commission has received and reviewed an actuarial impact statement related to this change attached as Exhibit 1; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens of the City of Tamarac to amend the plan to reflect these changes; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: CODING: Words in stFUGk thFeag-htype are deletions from existing law; Words in underscore type are additions Temp Ord. #2239 December 19, 2011 Page 2 of 5 SECTION 1: Section 16-901 of the City of Tamarac Code of Ordinances, is hereby amended to read as follows: Sec 16-901 Definitions Compensation shall mean a member's total cash remuneration for services rendered, excluding bonuses, employer contributions to any health, dental, disability or related insurance program, medical, of child care or other non-taxable reimbursement, employer contributions to a deferred compensation program under section 457 of the Internal Revenue Code, or cash payments of unused, accumulated leave payable upon sepaFat from the city. Effective July 1, 2011, any overtime pay in excess of 300 hours per year shall be excluded from the definition of compensation. SECTION 2: Sections 16-906(c) and (e) of the City of Tamarac Code of Ordinances, are hereby amended as follows: Sec.16-906 Vesting and Termination; purchase of prior covered service; appointment to covered positions from non - covered positions. For credited service accrued on or after January 1, 2012, interest shall be applied at the rate of two and one- half (2.5) percent, simple interest. (e) In no instance shall a member's benefits from the plan be less than the value of the employee's contributions, with interest at the rate of four (4) percent simple interest. For credited service accrued on or after January 1, 2012, interest shall be applied at the rate of two and one-half (2.5) percent, simple interest. SECTION 3: Section 16-906(k) of the City of Tamarac Code of Ordinances is hereby created to read as follows: Sec.16-906 Vesting and Termination; purchase of prior covered service; appointment to covered positions from non - covered positions. (k) Full-time employees of the City who otherwise met the requirements for membership in the Plan prior to or on October 1, 2005, but who chose to remain in the City's 401(a) Retirement Plan at the time this plan was created may elect to transfer into this plan. The CODING: Words in type are deletions from existing law; Words in underscore type are additions Temp Ord. #2239 December 19, 2011 Page 4 of 5 employee may elect to purchase no prior service, elect to purchase a portion of prior service for prior employment with the City, or elect to purchase all prior service for prior employment with the City. A decision to purchase service may be made at any time prior to retirement. The employee must pay the full actuarial cost for all prior service that is being purchased. The member shall pay the cost for any and all estimates or calculations performed by the Plan actuary. Full payment for any service being purchased must be made within 90 days of the date of the actuarial cost calculation. Purchased service under this subsection shall be used for meeting the vesting requirements of the plan, and shall count toward nears of credited service for meeting retirement eligibility and for benefit accrual purposes. SECTION 4: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made part of the Code of Ordinances of the City of Tamarac, Florida, and that the sections of this Ordinance may be renumbered or re -lettered, and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Temp Ord. #2239 December 19, 2011 Page 5 of 5 SECTION 6: If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
