ORDINANCE NO. 2012- 9 7
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, TO AMEND THE CITY'S SIGN
REGULATIONS BY SPECIFICALLY AMENDING CHAPTER 18,
"SIGNS AND ADVERTISING", OF THE CODE OF ORDINANCES
OF THE CITY OF TAMARAC, FLORIDA, PROVIDING FOR
CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Tamarac (hereinafter referred to
as the "City"), seeks to amend its regulations pertaining to the City's Sign Code
regulations by specifically amending Chapter 18, Signs and Advertising; and
WHEREAS, the City recognizes a need to amend Chapter 18 to update the City's
signage regulations to reflect current industry standards; and
WHEREAS, the City recognizes a need to update its current signage regulations
for the purpose of clarifying and organizing applicable code sections; and
WHEREAS, the proposed amendments are in keeping with the Goals, Objectives
and Policies of the Comprehensive Plan; and
WHEREAS, the Director of Community Development recommends approval of
these amendments; and
WHEREAS, the City Commission of the City of Tamarac has deemed it to be in
the best interest of the citizens and residents of the City of Tamarac to amend Chapter
18, Signs and Advertising, of the Code of Ordinances of the City of Tamarac, Florida to
clarify and organize these code sections and to provide for signage throughout the City
that is more safe, appropriate and improves the built environment appropriate.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1:
That
the foregoing 'WHEREAS" clauses are
hereby
ratified
and
confirmed as being
true
and correct and are hereby made a
specific
part of
the
Ordinance upon adoption hereof; all exhibits attached hereto are incorporated herein
and made a specific part of this Ordinance.
SECTION 2: That the City of Tamarac Code of Ordinances Chapter 18, Signs
and Advertising, Article II, is hereby amended to read as follows:
Chapter 18, Signs and Advertising
ARTICLE II. SIGNS
DIVISION 1, GENERALLY
Sec. 18-21. Statement of purpose.
The purpose of this article is to set forth, the criteria for the location, installation,
configuration, removal and other criteria for signs in the City of Tamarac. It is the intent
of this article to authorize the use of signs which aFe:
(1) Are Ocompatible with their surroundings;
(2) Are Aappropriate to the activity that displays them;
(3) Are expressive of the identity of individual activities and the community as a
whole; a
(4) Are L-legible in the circumstances in which they are seen..
(5) Promote the creation of an attractive visual environment that promotes an
aesthetically pleasing community; and
(6) Foster public safety along public and private streets within the comm_ty by
assuring that all signs are in safe and appropriate locations that do not create a
nuisance.

Sec. 18-22. Violations, penalties.
(a) Any persons, residents, business owners, or property owners violating any of the
terms, conditions, regulations or provisions of this article shall be subject to the
enforcement actions prescribed by this article.
(b) Contractors installing signs without a permit in the city are subject to fines,
penalties, or other legal - remedies authorized pursuant to state or local law.

Sec. 18-23. Enforcement.
(a) The director of community development, chief building official, or designee s

When determined by the chief building official or designee that a sign causes
imminent danger to the public safety and contact cannot be made with the sign or
property owner, the city may correct the danger by removina the sign.
Signs removed by the city shall become the property of the City of Tamarac and
may be disposed of in anv manner deemed appropriate by the city. The cost of
removal of the sign by the city shall be collected from the owner of the property
on which the sign
was located pursuant

Sec. 28-24. Definitions.
The following phrases, words and terms shall have the following meaning and basic
limitations:
Abandoned sign: Any sign which remains in
place after an area, community, subdivision, development, entity, enterprise, club,
institution, or business ' ' has changed names, is no
lonaer licensed. no lonaer has a certificate of occupancy, is no longer doing business, is
closed, or which no longer serves the intended purpose of the sign.

Address sign: A sign indicating the street address of a building, bay, space, or

overgrown by landscaping, has been defaced, has defective parts, is missing some or
all illumination or characters, is structurally unsound, has fallen into disrepair, fails to be

attention -getting with or without copy " .
Electronic time/temperature display: A changeable copy, lighted sign that changes to
display the current time, current temperature and/or current date for information only.
Electronic sign display: An illuminant advertising media which utilizes electronic
components to convert electric signals into a visual image (i.e. OLED, LCD, LED
technologies).
Entrance Wall Sign: A sign attached to an upright structure of masonry, wood,
plaster, or other building material which defines the access to a residential community_.
Facade: The exterior surface of a building or

Master residential area: The umbrella designation of a large master planned
residential subdivision which may contain two (2) or more residential developments (i.e.
Woodmont or The Woodlands).
Mobile billboard: An advertising display that is attached to a mobile, non -motorized
vehicle (such as a trailer), device or bicycle that carries, pulls or transports a sign or
billboard and is for the primary purpose of advertising. Also a motorized vehicle with
changeable copy for the purpose of advertising.
Model name sign: A temporary sign which designates a new residential
unit design which is exhibited to depict other new units of a similar design that are for
sale or lease.
Model sales office sign: A temporary sign used to identify a new residential housing
project model sales office.

The following are signs which shall not be installed in the municipal boundaries of the
city:
(1)Animated signs including signs which intermittently illuminate, flash, or chain
illumination colors;
(2)Sidewalk, of sandwich signs or A- frame signs;
(3)Snipe signs;
(4)Exposed neon tubes except for window signs described elsewhere in this

The following signs shall be exempt from the permit requirements of this

address all situations pertaining to the construction, erection, placement, repair,
alteration, relocation and maintenance of signs within the municipal boundaries
of the city. '

empowered and reserves unto itself the right to grant a variance to the
provisions of this Section. A request for a variance may be considered a
e� ON upon filing a petition with the Community Development Department. A
request for a variance from the provisions of this article may be appropriate in
cases where the sign variance is not contrary to the public interest, there are
special conditions which did not result from the actions of the applicant, and a
literal enforcement of the provisions of this chapter may result in unnecessary_
hardship. Each sign variance petition shall be considered on its own merit. In
order to be processed, a sign variance petition shall include a six hundred dollar
($600.00) application fee to cover administrative expenses incurred in the
processing of the petition. The petition shall be in writing, and shall state with
specificitv, the grounds on which the petitioner asserts that the variance has
been requested. '

the written petition and the payment of the six hundred dollar ($600.00) fee, the
city manager shall cause the petition for sign variance to be scheduled at the
next available Planning Board meeting for a public hearing. At such public

of variance. Following consideration by the Planning Board, the city manager
shall then forward the Planning Board's recommendation to the City Commission,
and cause said petition to be considered by the City Commission at a public
hearing. If the petition for sign variance is granted, the City Commission shall
cause an order to be issued stating the terms and conditions Won which the sian
variance has been granted and shall cause a copy of said order to be made a

concert event or when they are used in advertising, so long as they are
not used to simulate, copy or imply any official traffic warning either for
vehicles or pedestrians.

(16) Maintenance.
a. All components of every sign type, together with its framework and
structural supports, shall be well -maintained and aesthetically pleasing in
appearance. Signs must also be in a good and safe condition, .properly_
secured, supported and able to withstand wind pressures as required by
the applicable Building Code or anv other reaulatory code or ordinance in
effect within municipal limits.
b. All letters, lights and luminous tubes illuminating a sign shall be
maintained in good working condition. All replacement bulbs and lenses
shall be of the same wattage and color as the light it is replacing unless a
change is required to meet applicable Lighting Code requirements.
c. When visible components are replaced, the colors of the replacement
parts should match the existing components, taking into consideration
fading due to sun and environmental conditions, otherwise all parts of the
sign should be refurbished if this is not possible.
d. In the event that a wall sign is removed, all anchor holes shall be repaired
in such a way that all anchor holes are no longer visible and the wall must
be repainted to match the _existing color of the building within thirtv (30)
days of the removal of such sign.
e. The required perimeter landscaping for a monument sign must be
maintained by the owner in a safe and aesthetically pleasing condition at
all times. The owner is responsible for maintaining such required sign
landscaping so that the entire sign, exclusive of the base, is visible at all
times.
f. In the event that a monument or ground sign is removed, the location of
the removed monument or ground sign must be returned to a finished
condition in accordance with the landscaping provisions of this code.
17) All signs must be placed on the property in which thev serve unless
unique
situations
exist regarding limited access to the
property
as determined
by
the community
development director or
designee.
In cases
where unique
situations exist regarding limited access to
the property,
the sign
owner may
request
to locate
a sign in an adjacent property
or right-of-way,
provided that
the
applicant can
meet the following criteria:

certified

letter
from
the

owner
to receive the sign that he/she does not object to the location of the
sign in the adiacent popepror)eU or right-of-wav_.
b. Provide a hold harmless agreement with the property or right-of-way
owner to receive the sign recorded in the Public Records of Broward
County.
c. Provide an written agreement with the City of Tamarac and property
owner that when the rope!ly or right-of-way owner to receive the sign
requests removal of the sign through certified letter to the sign ownerL
the sign owner will remove the sign within ten (10) days of notice from
the property or right-of-way owner and return said property or right-of-
way to a finished condition in accordance with the Landscaping chapter
of this code.

2. The wall or space in which the fagade sign is located shall be
considered in determining the sign dimensions. Fagade sign
dimensions may not exceed seventy (70) percent of the width of
any wall or space on the building in which the sign is located. For an
individual tenant bay in a multiple tenant building, fagade sign
dimensions may not exceed seventy (70) percent of the width
between the tenant's demising partitions which separate adiacent
bays.
I Each separate street frontage shall be considered individually for
the purpose of determining maximum character and graphic
heights, unless otherwise specified elsewhere in this Chapter.
4. Non-residential fagade signs shall only display the business name
and/or business logo, or the primary use of the occupant except for

the street for non-residential properties.
4. For corner properties along official rights-of-wav, the maximum monument
sign height and area may be increased up to twenty-five (25) percent if
monument signage is limited to one (1) sign at the corner of the intersection
of the official rights -of -way in lieu of one (1) sign per street frontage.
5. An address sign shall be prominently displayed on all monument signs with a
minimum height of four (4) inches.
6. All monument signs allowed per street frontage must match in design,
color, illumination method and method of construction.

1. Flags of nations, states, counties, municipalities, civic organizations and/or
corporations may be exhibited in the proper manner.
2. All flagpoles, whether freestanding or attached to a building, require a
permit detailed in the Permits division of this chapter.
3. Within all residential zoning districts, only one (1) flagpole per property
may be erected containing no more than two (2) flags. Flagpoles attached
to a building shall contain one (1) flap per flagpole. The maximum area of
any flag is twenty-four (24) square feet. Flags attached to a pole attached
to a building shall not exceed fifteen (15) square feet. No flags of any_
commercial nature may be displayed within any residential districts.
4. Within all non-residential zoning districts, two (2) flagpoles per prop=rty
may be erected containing one (1) flag per flagpole or one (1) flagpole per
property containing two (2) flags. Flagpoles attached to a building shall
contain one (1) flag per flagpole. The maximum area of any one (1) flag is
sixty (60) square feet. Flags attached to a pole attached to a building shall
not exceed fifteen (15) square feet. Only one (1) corporate flap is
permitted which may contain the logo of the corporation located on the
property containing the flag pole. The building on the property must
contain a minimum gross floor area of twenty thousand (20,000) squ_
feet dedicated to a single business and the corporate flag must represent
this business.
5. For properties containing governmental institutions in free-standing
buildings, including public or private schools, a maximum of three (3)
flagpoles per property may be erected containing a maximum of three (3)
flags per pole. A maximum of two (2) flagpoles may be attached to the
freestanding building. Flag poles attached to a building shall contain one
(1) flap per pole. The maximum size of any one (1) flag is sixty (60) square
feet. Flags attached to a pole attached to a building shall not exceed
fifteen (15) square feet.
6. The _minimum required setback for flagpoles from all property lines shall
be equal to the overall height of the flagpole.
7. Flag poles shall not exceed the maximum height permitted by the Zoning
District. Flagpoles attached to a building shall not extend beyond the
existing building height including parapets. The flagpoles attached to a
building shall be located no higher than the top of the first floor.

uppermost portion of the building. The community development director or
designee may grant approval of an alternate location of facade signs
which identify the name the building, or business name and/or business
logo or the pr�ry use of the single tenant or anchor tenant, located
above the top of first floor on a multi -story building on a case -by -case
basis, based on architectural building features, through a written request
from the property owner or their authorized design_
(4) Outparcel buildings of commercial shopping centers or office

Sec. 18-86. Political signs.
[The following regulations shall apply to political signs:]
(1) The provisions of F.S. § 106.1435, as may be amended, shall apply to political
signs associated with an election or ballot issue placed within the city, but shall
not apply to those signs promoting issues or other matters of free expression not
associated with an election or ballot issue, and are incorporated herein as
follows:
a. Each candidate, whether for a federal, state, county, or district office, shall
make a good faith effort to remove all of this or her political campaign
advertisements within thirty (30) days after withdrawal of his or her
candidacy, having been eliminated as a candidate, or being elected to
office.
b. If political campaign advertisements are not removed within the specified
period, the city has the authority to remove such advertisements and may
charge the candidate the actual cost for such removal. Funds collected for
removing such advertisements shall be deposited to the general revenue
of the city.
(2) All signs shall be discarded in a proper manner so as to prevent litter and trash
from accumulating in the city. The city shall not remove or interfere with the
placement of political signs in the vicinity of a polling place, which otherwise
complies with state law, on an election day, unless necessary for public safety.
(3) No political signs shall be permitted to be posted in any public right-of-way or in
public parks.
(4) The prohibition contained in this subsection shall in no way apply to election
announcement signs posted by the city, announcing each election to be held in
the city.
(5) Political signs advertising a candidate for a specific election shall not exceed
twelve (12) square feet for each sign face, twenty-four (24) square feet aggregate
for each sign. For any single-family lot, no political sign shall exceed four square
feet.

SECTION 3: It is the intention of the City Commission and it is hereby ordained
that the provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may
be renumbered, relettered and the word "Ordinance" may be changed to "Section",
"Article" or such other word or phrase in order to accomplish such intention.
SECTION 4:
All Ordinances or parts of Ordinances, and all Resolutions or
parts of Resolutions in conflict herewith are hereby repealed to the extent of such
conflict.
