No. 2309 October 8, 2014 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 2014 - L_L_ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AMENDING CHAPTER 24 OF THE CITY'S CODE OF ORDINANCES, ENTITLED "ZONING" BY AMENDING ARTICLE II, ENTITLED "ADMINISTRATION", DIVISION 3 ENTITLED "PLANNING BOARD" BY SPECIFICALLY AMENDING SECTION 24-61 ENTITLED "CREATED MEMBERS", TO REVISE THE TERM OF OFFICE FOR PLANNING BOARD MEMBERS AND TO CREATE THE POSITION OF ALTERNATE MEMBER OF THE PLANNING BOARD IN ACCORDANCE WITH THE CITY CODE OF ORDINANCES; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac (the "City") seeks to amend the Code of Ordinances to create the position of alternate board member to the Planning Board (the "Board"), and to revise the term of office for Board members; and WHEREAS, Division 1, Section 2-59 of the City Code of Ordinances ("Code") provides for the terms of office for appointees to city advisory boards and committees; WHEREAS, the Planning Board members current terms and appointments are inconsistent with the general intent and requirements of Section 2-59 of the Code; and WHEREAS, the City believes that a quorum of the members of the Board is necessary and vital for the effective consideration of all matters that might be heard before the Board; and WHEREAS, the City Commission finds that revising the term of office of the members of the Planning Board to provide for consistency with Chapter 2-59 of the City Code, and amending the Code to create the position of alternate member to the Planning Board protects the public health, safety, and general welfare of the City and is CODING: Words in mike-�k�r-eta# type are deletions from existing law; Words in underlined type are additions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AS FOLLOWS: SECTION 1. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2. Chapter 24, Article II, Division 3 entitled "Planning Board", specifically at Section 24-61 entitled "Created; members" of the City of Tamarac Code of Ordinances is hereby amended as follows: Sec. 24-61. Created; members. (a) There is hereby created a planning board consisting of five (5) regular members, plus an additional two (2) alternate members. eEach regular � member shall serve a term of four (43) years to coincide with the term of the nominating member of the City Commission or until such time as new appointments are made; the appointment of the regular members shall be in accordance with Section 2-58(g) of the City of Tamarac Code. The two (2) alternate members shall be appointed by a majorLty vote of the Mayor and Commissioners. The term of the alternate members shall coincide with the election of the Mayor, and shall expire upon the term expiration of the Mayor, or until such time as new appointments are made. i6e s s o a co m %. v v %, ka.. The school board -appointed member may participate in all matters related to land use and zoning matters which, if approved, would increase residential density. Any interested citizen may be appointed to the r'nmm*ccinn board, but those with experience or interest in the following areas shall receive special consideration: p g Architecture or Landscape architecture Law Environmental Science Real Estate Development of Sales Urban Planning Engineering Neighborhood, Condominium or Homeowners Association Activist SECTION 3. Codification. It is the intention of the City Commission of the City of Tamarac that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, re lettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention SECTION 4. Conflicts. That all Ordinances or parts of Ordinances, Resolutions or parks thereof in conflict herewith, be and the same are hereby repealed to the extent of such conflict. SECTION 5. Severability. Should any section, provision, paragraph, sentence, clause or word of this Ordinance or portion hereof be held or declared by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall be considered as eliminated and shall not affect the validity of the remaining portions or applications of this Ordinance.
