Ordinance #2129-January 12, 2007 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 2007-��� AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AMENDING CHAPTER 6 OF THE CITY OF TAMARAC CODE OF ORDINANCES, ENTITLED "FINANCE AND TAXATION", BY AMENDING ARTICLE II, ENTITLED "FEES AND FUNDS"; SPECIFICALLY CREATING SECTION 6-41, TO BE ENTITLED "FUND BALANCE POLICY"; PROVIDNG THE CITY MANAGER WITH THE AUTHORITY TO ADJUST FUNDING IN ORDER TO BALANCE THE BUDGET WITH OR WITHOUT THE APPROVAL OF THE CITY COMMISSION; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac (hereinafter referred to as the "City"), pursuant to Article VI of the City Charter, is required to perform an audit of the City's funds at the end of each fiscal year to determine the exact balance of the City's fund; and WHEREAS, the City Commission, in an effort to ensure fiscal efficiency and maintain a prudent level of financial resources, desires to authorize the City Manager, or his or her designee, to allocate surplus capital in order to balance the budget and protect against fiscal deficiencies resulting from revenue shortfalls or unexpected expenditures; and WHEREAS, the City Commission further desires that only ten percent (10%) of the City's budget shall remain undesignated; and WHEREAS, currently the City's ability to allocate City funds is prolonged because of the present budgetary procedure; and CODING: Words in stroke *emu type are deletions from the existing law; Words in underscore type are additions Page 1 of 4 Temp. Ordinance #2129-January 12, 2007 Page 2 WHEREAS, the Director of Financial Services recommends that Chapter 6, Finance and Taxation, Article II. Fees and Funds, Section 6-41, Fund Balance Policy be created in the Tamarac Code of Ordinances to address inconsistencies which currently exist in the financial reporting requirements for the City; and WHEREAS, the City Commission deems it to be in the best interests of the City to create Section 6-41 of the City's Code of Ordinances, to be entitled "Fund Balance Policy", providing the City Manager, or his or her designee, with the authority to adjust funding allocation in order to ensure a balanced budget. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Ordinance #2129-January 12, 2007 Page 3 SECTION 2: The City Commission of the City of Tamarac hereby amends Chapter 6, entitled "Finance and Taxation," of the City of Tamarac Code of Ordinances by amending Article II, entitled "Fees and Funds"; by creating Section 6-41, to be entitled "Fund Balance Policy", as follows: Sec. 6-41 Fund Balance Policy The City Manager, or his or her designee, is hereby authorized, to allocate or reallocate funds in order to provide for a balanced budget and protect against temporary revenue shortfalls or unexpected expenditures. Such reallocated funds shall come from the portion of the City's budget that remains undesignated in order to ensure that only ten percent (10%) of such budget remains undesignated, in accordance with Section 7.03 of the City Charter. Such adjustments shall thereafter be reported to the City Commission by the City Manager. SECTION 3: It is the intention of the City Commission of the City of Tamarac that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, re -lettered and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this ordinance are to be severable.
