Ord. 2149 8-31-07 Page 1 of 4 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 2007- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AMENDING CHAPTER 14 OF THE CITY OF TAMARAC CODE OF ORDINANCES, ENTITLED "MOTOR VEHICLES AND TRAFFIC", BY SPECIFICALLY AMENDING ARTICLE II, ENTITLED "STOPPING, STANDING AND PARKING", BY CREATING SECTION 14-40, TO BE ENTITLED "IMPOSITION OF SURCHARGE FOR VIOLATION OF PARKING ORDINANCES"; PROVIDING FOR THE IMPOSITION OF A SURCHARGE FOR PARKING VIOLATIONS TO HELP FUND SCHOOL CROSSING GUARDS IN THE CITY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 318.21(12)(a), Florida Statutes, provides that a municipality may impose and collect a surcharge on parking fines for the purposes of funding school crossing guard programs; and WHEREAS, Chapter 14, Article II of the City of Tamarac's Code of Ordinances provides for certain parking prohibitions and sets forth penalties for violations thereof; and WHEREAS, with the commencement of the 2007/2008 academic school year there is an increased number of people, particularly children, walking on City streets; and CODING: Words in o+riLo th., ugh type are deletions from the existing law; Words in underscore type are additions SSG/JGH 4-21-07 CADocuments and Settings\patt\Local Settings\Temporary Internet Files\OLKF4\TO2149 Crossing Guard Surcharge.doc Temp. Ord. 2149 8-31-07 Page 2 of 4 WHEREAS, the recent property tax reform initiated by the Florida Legislature results in an increased need for municipalities to take advantage of all available resources and options to help fund additional programs, such as school crossing guards; and WHEREAS, the City Commission, in an effort to better protect the health, safety and welfare of all of the citizens and residents of the City, deems it to be in the City's best interest to impose a surcharge on parking violations to help fund school crossing guards. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: The City Commission of the City of Tamarac hereby amends Chapter 14, entitled "Motor Vehicles and Traffic," of the City of Tamarac Code of Ordinances, by specifically amending Article II, entitled "Stopping, Standing and Parking", by creating Section 14-40, to be entitled "Imposition of Surcharge for Violation of Parking Ordinances", as follows: CODING: Words in Steer type are deletions from the existing law; Words in underscore type are additions SSG/JGH 8-31-07 CADocuments and Settings\patt\Local Settings\Temporary Internet Fi1es\0LKF4\T02149 Crossing Guard Surcharge.doc Temp. Ord. 2149 8-31-07 Page 3 of 4 Sec. 14-40. Imposition of Surcharge for Violations of Parking Ordinances Pursuant to Section 318.21 12 a F.S. as amended from time to time a surcharge in the amount of One Dollar 1.00 shall be levied and collected for violations of this Article or any other parking violations. The proceeds from this surcharge shall be used to help pay the costs of the school crossing guards in the City. SECTION 3: It is the intention of the City Commission of the City of Tamarac that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, re -lettered and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this ordinance are to be severable. SECTION 6: This Ordinance shall become effective immediately upon adoption.
