CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-2008-
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, AMENDING CHAPTER 5, ENTITLED,
"BUILDINGS AND BUILDING REGULATIONS", ARTICLE I, "IN
GENERAL", SECTION 5-1, ENTITLED, "BUILDING DEPARTMENT
PERMIT FEES", ADDING THE REQUIREMENT FOR AUTOMATIC
ANNUAL ADJUSTMENTS TO THE BUILDING DEPARTMENT PERMIT
FEE SCHEDULE; PROVIDING FOR CODIFICATION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, it is the responsibility of the Director of the Building Department and
the Director of the Financial Services Department of the City of Tamarac, Florida, to
ensure that adequate revenues exist to cover operation, maintenance, replacement and
overhead expenses; and
WHEREAS, the Building and the Financial Services Departments have
recommended fee increases forthe Building Permit Fees in the FY 2008 Adopted Budget;

WHEREAS, it is further recommended that automatic annual fee adjustments be
made in order to mitigate the need for future lump sum fee increases; and
WHEREAS, the U.S. Consumer Price Index is a customary national standard used
to establish fee adjustments; and

WHEREAS, Section 5-1, of the City of Tamarac Code of Ordinances must be
amended to authorize the adoption of automatic annual adjustments to Building Permit
Fees pursuant to the U.S. Consumer Price Index for the period; and
WHEREAS, the amendment will become effective October 1, 2009, and every
October 1, thereafter; and
WHEREAS, the Director of the Building Department and the Director of the Financial
Services Department recommend approval of the proposed amendment to Chapter 5,
Article I, Section 5-1; and
WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the
best interest of the citizens and residents of the City of Tamarac to amend Chapter 5,
entitled `Buildings and Building Regulations", Article I, "in General", Section 5-1, entitled,
"Building Department Permit Fees" to provide annual rate adjustments commensurate with
the U.S. Consumer Price Index.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing whereas clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Ordinance
upon adoption hereof.
SECTION 2: Chapter 5, entitled "Buildings and Building Regulations",
Section 5-1, entitled "Building Department Permit Fees", of the Tamarac Code is hereby
amended to read as follows:

Sec. 5-1. Building Department Permit Fees.
(a) The city commission shall have the power and the duty to review,
alter, add to, modify, deduct from or in any way change any fees
or any categories on any schedule of building permit fees in
existence or to be in existence by a resolution adopted by the
city commission. Commencing on October 1, 2009, and effective
on October 1, of each year thereafter, all Building Department
Permit Fees then in effect shall beadjusted automatically,
without further action by the City Commission, by the greater of
3% or the U. S. Consumer Price Index (CPI) as determined in
June of the calendar year of adjustment. Every two years, the
City Manager, or his designee, shall review the effects of inflation
and other costs such as labor and materials to determine
whether the building permit fees require further adjustment with
the first such fee adjustment to be effective beginning October 1,
2010.
SECTION 3. It is the intention of the City Commission and it is hereby
ordained that the provisions of this Ordinance shall become and be made a part of the
Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this
Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to
"Section", "Article" or such other word or phrase in order to accomplish such intention.
SECTION 4. All Ordinances or parts of Ordinances and all Resolutions or
parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 5. If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Ordinance that can be given affect without the invalid provision or
application, and to this end the provisions of this Ordinance are declared to be severable.
