HomeMy WebLinkAboutCity of Tamarac Ordinance O-2008-008Temp Ord #2151 June 2, 2008 2nd Reading Page 1 of 4 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2008-®OO AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ADOPTING THE EVALUATION AND APPRAISAL REPORT (EAR) BASED AMENDMENTS FOR THE CITY OF TAMARAC 1998 COMPREHENSIVE PLAN; STATING THE INTENT OF THE MAYOR AND CITY COMMISSION OF THE CITY OF TAMARAC TO AMEND THE CITY'S 1998 COMPREHENSIVE PLAN IN ACCORDANCE WITH THE RECOMMENDATIONS CONTAINED IN THE EAR REPORT TO THE DEPARTMENT OF COMMUNITY AFFAIRS IN ACCORDANCE WITH FLORIDA STATUTES (CASE NO. 17-MI-07) PROVIDING FOR CONFLICTS, PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing process; and WHEREAS, provisions of the Local Government Comprehensive Planning and Land Development Regulation Act of 1985 require adoption of a comprehensive plan; and WHEREAS, the Mayor and City Commission of the City of Tamarac has adopted the City of Tamarac Comprehensive Plan, Ordinance No. 0-98-12 on May 13, 1998; and WHEREAS, Section 163.3191 Florida Statutes requires local governments to adopt an evaluation and appraisal report once every seven (7) years assessing the progress in implementing the local government's comprehensive plan; and WHEREAS, the Mayor and City Commission of the City of Tamarac has adopted the Evaluation and Appraisal Report (EAR), Resolution No. 2006-56 on April 11, 2007; and I Temp Ord #2151 June 2, 2008 2nd Reading Page 2 of 4 WHEREAS, the City of Tamarac Planning Board, acting as the designated Local Planning Agency, has reviewed the Evaluation and Appraisal Report (EAR) Based Amendments, held an advertised public hearing on October 3, 2007 and October 17, 2007, provided for participation by the public in the process, and has made a recommendation to formally transmit the Evaluation and Appraisal Report (EAR) Based Amendments to the State of Florida Department of Community Affairs (DCA) and all other jurisdictional agencies for their review; and WHEREAS, the Evaluation and Appraisal Report (EAR) Based Amendments will be transmitted to the State of Florida Department of Community Affairs (DCA) and all other jurisdictional agencies having jurisdiction over the Amendments for review and comment, all as provided by law; and WHEREAS, the Director of Community Development recommends transmittal of the Evaluation and Appraisal Report (EAR) Based Amendments to the State of Florida Department of Community Affairs (DCA) and all other jurisdictional agencies having jurisdiction over the Amendments for review; and WHEREAS, the Mayor and City Commission of the City of Tamarac has reviewed the Evaluation and Appraisal Report (EAR) Based Amendments, held an advertised public hearing on October 24, 2007, and provided for comments and public participation in the process in accordance with the requirements of state law and the procedures adopted for public participation in the planning process; and E 1 1 Temp Ord #2151 June 2, 2008 2nd Reading Page 3 of 4 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to adopt the Evaluation and Appraisal Report (EAR) Based Amendments for the City of Tamarac 1998 Comprehensive Plan; stating the intent of the Mayor and City Commission of the City of Tamarac to amend the City's 1998 Comprehensive Plan in accordance with the recommendations contained in the report to the State of Florida Department of Community Affairs (DCA) in accordance with Florida Statues. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon hereof. SECTION 2: The Mayor and City Commission of the City of Tamarac does hereby adopt the Evaluation and Appraisal Report (EAR) Based Amendments for the City of Tamarac 1998 Comprehensive Plan (attached hereto as Exhibit 1 "). SECTION 3: The Mayor and City Commission of the City of Tamarac does hereby approve the transmittal of the Evaluation and Appraisal Report (EAR) Based Amendments to the Florida State Department of Community Affairs (DCA) for the purpose of a sufficiency review in accordance with Florida Statutes. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall become effective immediately upon expiration of a twenty-one (21) day appeal period subsequent to the publishing of a Notice of Intent to find in compliance by the State of Florida Department of Community Affairs (DCA). FUTURE LAND USE ELEMENT GOAL The City of Tamarac will provide land uses which will encourage the orderly growth of the community; maximize economic benefits; conserve and protect the natural environment.; and minimize any threats to health, safety, and welfare. Objective 1 The City of Tamarac intends to promote orderly growth and development through the adoption, maintenance, and implementation of its Future Land Use Element. In addition, the City will continue and enhance throughout the planning period, its Code Enforcement Division to prevent and remove blight. The City will continue to monitor through its Community Development Department demographic and economic data concerning all neighborhoods in the City, and will apply for grants in aid for beautification, safe neighborhoods, parks and recreation improvements, and other facilities and service improvements throughout the planning period. Policy 7.6 The City_shall require redevelopment within identified floodplains to address existinp, flooding problems. Objective 9 The City of Tamarac will continue to keep in place subdivision and other land development regulations which promote well planned, orderly, and attractive development which is consistent with the City's adopted Capital Improvement Element and with the goals, objectives, and policies of the Broward County Land Use Plan. Policy 9.1 City of Tamarac Subdivision and Site Plan Regulations shall continue to incorporate a review process for assessing the adequacy of public services and facilities. New development shalt be established only within those areas where adequate public services and facilities exist, or are scheduled to be available, in accordance with the City's adopted Capital Improvement Element. Policy 9.2 The City's Land Development Code shall continue to provide for both timely completion and regular maintenance of all required capital improvements and amenities. Policy 9.4 The City shalt continue to account for the City's tourist and seasonal populations when making projections or sizing infrastructure or facilities. Policy 9.5 l-he City shall continue to implement its Land Development review procedures to assure that facilities and services meet the City of Tamarac and 6roward County level of service standards and that these are available concurrent with the impact of development. Policy 9.6 The City of Tarnarac development review permits shall be consistent with the "Development. Review Requirements" section of the aroward County Land Use Plan. Policy 9.7 The City of Tamarac shalt institute procedures to identify the cumulative effect of proposed development on public services and facilities. Policy 9.8 The City of Tamarac shall encourage source separation and recycling of solid waste in accordance with the Flori da Solid Waste Act of 1988 as amended as of 1993. Policy 9.9 The City shall develop and implementpost-disaster redevelopment and hazard mitigation land use controls and develop regulations includin strong preventative measures, to protect the health, safety andwelfare of Tamarac's current and future residents. Policy 10.1 The Tamarac Future Land Use Element shall continue to contain land use policies for commercial development which will act as the basis for the Land Development Code provisions which are written to protect residential areas. Policy 10.3 The Commercial and Industrial Policirs of this Land Use Element are the basis for the C_ity's cornmcrcial and industrial zoning categories. Policy 10.4 The City shall continue to implement, its Land Development regulations which address the noise, vibration, air' pollution, glare, heat, solid waste, hazardous waste, fire, and explosion impacts of industry. Policy 10.5 All new corruriercial and industrial development in the City of Tamarac shall be serviced by centralized wastewater systems. Policy 10.6 Amendments to the City of Tamarac Future Land Use Map which proposed land use categories within wellfield protection zones of influence which are in conflict with the provisions of the Broward County Wellfield Protection Ordinance shall not be granted. Policy 10.7 Mining operations, except for onsite dredge and fill for permitted projects in the City of Tamarac, are not permitted in the City of Tamarac. Policy 10.9 The City shall continue and upgrade as necessary its Land Development Code requirements for buffering and setbacks for incompatible uses, including, but not limited to, overhead electric lines and electric substations and power lines. Middle school Student Capacity: Site Size: Dimensions (Feet): 1,719 20 Acres 1,250 (front) x 730 (depth) Middle schools have a community orientation, and a limited mix of commercial and residential uses nearby is acceptable. Community parks, athletic fields, community centers, and libraries are appropriate for collocation. High school Student Capacity: Site Size: Dimensions (Feet): 2,677 45 Acres 1,300 (front) x 1,500 (depth) High schools should be buffered from residential areas. The campus should be large enough to encourage students to remain onsite and to ensure sufficient parking and traffic controls to avoid disruptive offsite parking and dangerous driving situations on neighborhood roads. Given that approximately 78 percent of all lands within Tamarac have future land use designations that permit public schools, it is reasonable to assume that future land use designations will not be a impediment in location and development of new public school sites. Policy 2019.3The City of Tamarac, in its effort to assist in providing suitable locations for new public schools, shall encourage collocation of new schools with existing and new public facilities, including libraries, parks, and community centers. The following criteria shall be used in selecting appropriate sites: 1. Availability of vacant land and adjacent land use patterns; 2. Demographics; 3. Applicable health, safety, and welfare issues impacting the proposed site(s) (i.e., contaminated sites, wellfield protection); 4. Level of service standards for existing infrastructure and necessary upgrades to accommodate new educational facility; and 5. Proximity to existing residential neighborhoods and mass transit. Capital improvements will be directed toward correcting existing deficiencies, maintenance of all existing facilities, and to provide for future growth. Monitoring and Evaluation: • Objective can be evaluated in terms of its implementing policies. Policy 1.1 The City of Tamarac shall revise and adopt annually a Capital Improvement Program (CIP) -and sh-all iWilde all that addresses the existing and projected deficiencies as outlined in the Capital Improvement Element and those items listed in the five-year schedule of improvements. Policy 1.2 The City of Tamarac shall update its Capital Improvement Element CIE on an annual basis after the adoption of the Capita[ Improvement Program and submit the CIE to the State Planning Agency, DCA, annually as a Comprehensive Plan Amendment. Policy 1.3 Policy 1.4 The City shall continue using the Needs Assessment Committee composed of the Director of Public Works, Financial Services, and Community Development which shall prioritize projects for the CIE, those projects in the five-year Schedule of Improvements, and the annual proposed capital budget. Will the project eliminate or correct existing deficiencies, increase capacity of existing facilities, or reduce the necessity for or cost of future improvements or provide for future needs? 4. Will the project provide services to developed areas lacking services, or be a logical extension or expansion of facilities or services within designated service areas? 5. Will or can funds be available for the project? Can operating and maintenance costs associated with the improvement be provided from the annual operating budget? Objective 2 Future development shall be responsible for bearing a proportionate fair share of the cost for improvements in order to maintain adopted Level of Service (LOS) standards. Monitoring and Evaluation: • The balance of development revenues collected versus the cost of improvements. Policy 2.1 The City of Tamarac shall continue its policy of collecting impact fees from future development for traffic, recreation, open space, drainage retention, water, and sewers. Policy 2.2 The City of Tamarac shall continue its policy of mandatory dedications or fees in lieu of dedications as a condition of plat or site plan approval for recreation open sites and development of recreation facilities for residential developments. Policy 3.1 Section 7.16 of the City Charter states, "The City shall have full power and authority to issue municipal bonds or to borrow funds for municipal purposes to the extent authorized by and subject to the limitations provided in the Constitution of the State of Florida, the Municipal Home Rule Law, other statutes and this Charter; provided further that bonds intended for the funding or refunding of an acquisition or construction of a capital project shall not be issued until such project and such issuance has been approved by a majority of the qualified electors voting on the issue at a special or general election." Policy 3.2 The Financial Services Director recommends that the City maintain a debt burden, defined as debt service payments, of less than fifteen percent (15 %) of combined operating and debt service expenditures. Policy 3.3 The City shall adopt as part of its annual budget, a schedule for the depreciation and periodic replacement of capital facilities from current revenues. Policy 3.4 The City Manager shall submit to the City Commission an updated five- year Capital Improvement Program annually. The capital program shall include a summary of its contents and a list of all capital improvements which are proposed for the next five (5) fiscal years with appropriate detailed information. Whenever so requested by the Commission or otherwise required, the manager shall make recommendations for revisions of the program. City of Tamarac 3 Comprehensive Plan October 2007 VIII. Policy 4.6 During the planning period, the City shall use the following criteria for the consideration of the plans of state agencies and the South Florida Water Management District during the City's evaluation of capital improvement projects." These criteria include the following: Project is needed by the city; 2. Project is funded by appropriate agency; and 3. City has funds available to meet any required local match. Policy 4.7 Public facilities to serve developments for which development orders were issued prior to the adoption of the Tamarac Comprehensive Plan, provided those development orders meet all provisions of the Land Development regulations, shall be available. Capital Improvements Element Goals, Objectives & Policies Policy 4.8 Management System, as identified in the Tamarac Code of Ordinances, already provides for facilities monitoring and development permit monitoring which will ensure availability as required during the planning period. City of Tamarac traffic impact fees shall only be used for city streets. Since Broward County collects regional traffic impact fees (for the County road system) the city shall not collect fees for those same roads. Any state roads in Tamarac are covered by the regional road system and not: eligible for city impact fees. Based on Chapter 163, Florida Statutes, and Rule Chapter 9,1-5, Florida Administrative Code, we have prepared the attached Objections, Recommendations and Comments Report that outlines our findings concerning the amendments. It is particularly important that the City address the objections set forth in our review so that the identified issues can be successfully resolved prior to adoption. A copy of local, regional and state agency comments are also enclosed for your consideration. For your assistance, a summary of the procedures for final adoption and transmittal of the amendments is included with our report. City of Tamarac has proposed its EAR based amendments to update its entire comprehensive plan. In our review of these amendments, the Department has identified two objections and six comments. The Department has identified objections related to the Five -Year Schedule of Capital Improvements and the adoption timeframe for the Public School Facilities Element. The City must include the Five -Year Schedule of Capital Improvements in the adopted portion of the comprehensive plan and adopt the Public School Facilities Element by February 1, 2008. OBJECTIONS, RECOMMENDATIONS AND COMMENTS REPORT CITY OF TAMARAC PROPOSED COMPREHENSIVE PLAN AMENDMENT 08-IER Introduction The following objections, recommendations and comments are based upon the Department's review of the City of Tamarac 08-1ER proposed amendment to its Comprehensive Plan pursuant to s. 163.3184, Florida Statutes (F.S.). The objections relate to specific requirements of relevant portions of Chapter 9J-5, Florida Administrative Code (F.A.C), and Chapter 163, Part II, F.S. Each objection includes a recommendation of one approach that might be taken to address the cited objection. Other approaches may be more suitable in specific situations. Some of these objections may have initially been raised by one or more of the other external review agencies. If there is a difference between the Department's objection and the external agency advisory objection or comment, the Department's objection would take precedence. Each of these objections must be addressed by the City and corrected when the amendment is resubmitted for our compliance review. Objections that are not addressed may result in a determination that the amendment is not in compliance. The Department may have raised an objection regarding missing data and analysis items, which the local government considers not applicable to its amendment. If that is the case, a statement justifying its non -applicability pursuant to Rule 9J-5.002(2), F.A.C., must be submitted. The Department will make a determination on the non -applicability of the requirement, and if the justification is sufficient, the objection will be considered addressed. The comments that follow the objections and recommendations section are advisory in nature. Comments will not form bases of a determination of non-compliance. They are included to call attention to items raised by our reviewers. The comments can be substantive, concerning planning principles, methodology or logic, as well as editorial in nature dealing with grammar, organization, mapping, and reader comprehension. Appended at the end of the Department's ORC Report are the comment letters from the other state review agencies and other agencies, organizations and individuals. These comments are advisory to the Department and may not form bases of Departmental objections unless they appear under the "Objections" heading in this report. 7 Transmittal Procedures Upon receipt of this letter, the City of Tamarac has 120 days in which to adopt, adopt with changes, or determine that the City will not adopt the proposed amendment. The process for adoption of local government comprehensive plan amendments is outlined in s. 163.3184, F. S., and Rule 9J-11.011. F.A.C. The City must ensure that all ordinances adopting comprehensive plan amendments are consistent with the provisions of Chapter 163.3189(2)(a), F.S_ Within ten working days of the date of adoption, the City must submit the following to the Department: Three copies of the adopted comprehensive plan amendments; A listing of additional changes not previously reviewed: A listing of findings by the local governing body, if any, which were not included in the ordinance; and A statement indicating the relationship of the additional changes to the Department's Objections, Recommendations and Comments Report. The above amendment and documentation are required for the Department to conduct a compliance review, make a compliance determination and issue the appropriate notice of intent. In order to expedite the regional planning council's review of the amendments, and pursuant to Rule 9J- 11.011(5), F.A.C., please provide a copy of the adopted amendment directly to the Executive Director of the South Florida Regional Planning Council. Please be advised that Section 163.3184(8)(c), F.S., requires the Department to provide a courtesy information statement regarding the Department's Notice of Intent to citizens who furnish their names and addresses at the local government's plan amendment transmittal (proposed) or adoption hearings. In order to provide this courtesy information statement, local governments are required by law to furnish the names and addresses of the citizens requesting this information to the Department. Please provide these required names and addresses to the Department when you transmit your adopted amendment package for compliance review. In the event there are no citizens requesting this information, please inform us of this as well. For efficiency, we encourage that the information sheet be provided in electronic format. 1, Consistency with Chapter 163, F.S., and Rule 9J-5, F.A.0 Summar City of Tamarac's proposed 08-1ER amendment package was received by the Department on November 21, 2007. The amendment packet contained text amendments to all ten elements of the City's Comprehensive Plan: Future Land Use, Transportation, Housing, Infrastructure. Conservation, Recreation and Open Space, Intergovernmental Coordination, and Capital Improvements Elements. The Department has identified two objections. The City must adopt a Five -Year Schedule of Capital Improvements and adopt its Public Education Facilities Element by February 1, 2008. A. Objections and Recommendations Objection 1: The City's Five -Year Schedule of Capital Improvements has been deleted from the goals, objectives and policies section of the Capital Improvements Element and has been placed in the data and analysis section of the comprehensive plan. [Authority: Section 163.3177(3)(a)5, (b)1, and (3)(a)c F.S.; Rules 9J-5.016(1), (2), (3)(b)1, 3, 5, (3)(c)1, 3, 6, and (4), F.A.C.] Recommendation: The Five -Year Schedule of Capital Improvements must be adopted as part of the City's comprehensive plan. Objection 2: Objective 2 and Policy 2.3 of the Intergovernmental Coordination Element states that the City will adopt its Public School Facilities Element by December 2008 which is inconsistent with the schedule that requires the City to adopt its Public Schools Facilities Element by February 1, 2008. Recommendation: Revise Objective 2 and Policy 2.3 to specify that the due date for the City to adopt its Public School Facilities Element, execute the Public Schools InterlocaI Agreement and implement school concurrency is February 1, 2008. The City should note that Section 163.3177(12)0), F.S.., prohibits local governments from adopting amendments that increase residential density until the Public School Facilities Element is adopted if not adopted by the scheduled adoption date. Authority: Sections 163.3177(12)(c) and 0), 163.3180(13), F.S.; Rule 9J-5.025(2), (3) and (4), F.A.C.] Comment 1: The reference to the Federal Emergency Management Administration (FEMA) is incorrect. The name of FEMA is the Federal Emergency Management Agency. In the data and analysis section of the Future Land Use Element, the table numbers referenced within the text (e.g. Table 3) and table titles (e.g. Table 1.3) need to be corrected to reflect the correct table numbers. Table 1.4 provides projected and estimated population and number of dwelling units up to 2030, which is beyond 2025 as referenced on page 8 of the data and analysis segment. Comment 2: The Florida Department of State, Division of Historical Resources, has indicated that there is one recorded existing historic resource (a site) within the City (archaeological site number 8BD2136). There are no recorded historic structures. The Department recommends that the City establish standards for evaluating historic structures using National Register significance. criteria. Comment 3: Revise the table numbers throughout the data and analysis section of the Infrastructure Element to reflect the table numbers associated w ith the titles of the tables. 4 Comment 4: On pages 5, 7. 8, 9, and I I of the Conservation Element, there are place holder references to exhibits for wellhead protection areas (Exhibit 12), FEMA flood zones (Exhibit 11), wetlands (Exhibit 14), soils (Exhibit 15) and natural resources (Exhibit 16). daps of these areas are provided as Map 1.6 (wetland protection areas), Map 1.7 (FEMA flood zones), Map 1.8 (wetlands), Map 1.9 (soils), and Map I.10 (natural resources) in the Future Land Use Element. The references to the natural resources areas in the Conservation Element should be revised to reference the rnaps in the Future land Use Element. Comment 5: Complete Table 7. 1: Interlocal and Service Agreement Matrix in the Intergovernmental Coordination Element. H. Consistency with Chapter 187, F.S. The proposed amendment is inconsistent with the following provisions of Chapter 187, F.S., the State Comprehensive Plan: Goal (17) Public Facilities, Policies 1, 2, 3, 4, 5, 6, 7, and 9. These policies relate to Objection 1. Goal (25) Plan Implementation, Policy (b)7: Ensure that local plans implement and accurately reflect state goals and policies. This policy relates to Objections 1 and 2.
