Ordinance # 2162 May 31, 2008 Page 1 of 4 ORDINANCE NO. 2008- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 16 ENTITLED, "PENSIONS AND RETIREMENT", BY SPECIFICALLY AMENDING SECTION 16-56 ENTITLED, "MEMBERS"; REDUCING THE NUMBER OF ALTERNATES ON THE BOARD OF TRUSTEES FROM FOUR (4) TO THREE (3); PROVIDING THAT MAYOR NEED ONLY TO APPOINT ONE (1) TRUSTEE TO SERVE ON THE BOARD OF TRUSTEES; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 16, Division II of the City of Tamarac (hereinafter referred to as the "City") Code of Ordinances creates a Board of Trustees to oversee the City's employee pension fund; and WHEREAS, the Board of Trustees is currently comprised of five (5) trustees and four (4) alternate trustees; and WHEREAS, Section 16-56 specifically describes the appointment process for the Board's trustees, and expressly provides that the Mayor shall appoint one (1) trustee and one (1) alternate from the City Commission to serve on the Board of Trustees; and WHEREAS, the Mayor's appointees, pursuant to Section 16-56(2) may also serve on the City's police officer pension plan, firefighter pension plan, or both; and CODING: Words in StFike through type are deletions from the existing law; Words in underscore type are additions. Ordinance # 2162 May 31, 2008 Page 2 of 4 WHEREAS, as a matter of housekeeping, the City Commission desires to modify the number of alternate trustees on the Board of Trustees from four (4) to three (3); and WHEREAS, the City Commission deems it to be in the best interests of the citizens and residents of the City for the City's Board of Trustees for the employee pension fund to be reduced from four (4) alternates to three (3) alternates. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: Chapter 16 entitled, "Pension and Retirement", is hereby amended by specifically amending Division II, Section 16-56, entitled "Members" to read as follows: Sec. 16-56. Members. (a) The plan shall be administered by five (5) trustees and f'etf-W three (33) alternate trustees, as follows: (1) Three (3) trustees and two (2) alternates shall be elected by the plan participants. Ordinance # 2162 May 31, 2008 Page 3 of 4 The. mayor's appointee must, at all times while serving as a trustee, be, a member of the Cit Commission (3) One (1) trustee and one (1) alternate shall be appointed by the city manager who -tray a4se- serve -as trustee f„r eithe _ the off+cer-plan-of--t4ief+ref0--ter--plaa--or both --plans. _The city manager may appoint himself or herself as a trustee or alternate. Should the city maner ?ppoint another person as a trustee or alternate, that person must, at all times while serving as a trustee or alternate, be a.._City employee.,- ( 4-t4) Alternate trustees shall, in the absence of the regularly appointed trustees, have all of the powers of trustees. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4. All Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
