CJ E L.J CITY OF TAMARAC, FLORIDA CITY COUNCIL BUDGET PUBLIC HEARING FOR FY 1986/87 September 8, 1986 CALL TQ ORDER: Mayor Hart called the meeting to order at 6:00 P.M. on Monday, September 8, 1986, at the Tamarac Recreation Building, 7501 University Drive, Tamarac, Florida. ROLL CALL: PRESENT: Councilwoman Helen Massaro Vice Mayor Jack Stelzer Councilman Arthur H. Gottesman Councilman Sydney M. Stein Mayor Bernard Hart ALSO PRESENT: John P. Kelly, City Manager A. Bryant Applegate, City Attorney Carol E. Barbuto, Assistant City Clerk Patricia Marcurio, Secretary 1. Proposed Millage Rate - Temp. Reso. #4250 - To adopt an aggregate proposed millage rate for FY 1986/87. SYNOPSIS OF ACTION: APPROVED an aggregate millage rate of 3.35 with a 6% utility tax. Public hearing was held. RESOLUTION NO. R-86-284 PASSED. Mr. Applegate read Temp. Reso. #4250 by title. C/M Stein said Tamarac is almost completely unionized; therefore, approximately 70% of the budget is fixed before the Council handles it. He said these costs, along with increased costs for insurance and electricity, etc., comprise the 70% fixed amount. EDITOR'S NOTE: Both Tape 1 and Tape 2 were defective; therefore, the report read into the record by V/M Stelzer is Attachment 1 to these Minutes. Mayor Hart opened the public hearing. Former Mayor, Walter Falck, present Executive Director of the Broward League of Cities, thanked Council for the City's last contribution of $5,000.00 to the Area Agency on Aging. He urged Council to consider an even larger contribution this year since there are approximately 85% elderly residents in Tamarac. He also noted that most cities in the League do have utility taxes. Melanie Reynolds, resident, asked if the Planning Commission will continue to receive reimbursement for lunches and she questioned why the Board of Adjustment does not receive reimbursement for travel to various sites on their agendas. She questioned what will happen regarding a Police Facility if the City does go with the BSO. V/M Stelzer noted that the monies involved with lunches for the Planning Commission or the Board of Adjustment are minimal amounts. C/W Massaro said if all the monies in the Parks and Recreation and Drainage Improvement Funds were combined, they would total approximately between 15 and 20 million dollars. She noted that these monies cannot be touched and are invested by the City. C/M Stein said the total budget is approximately 45 million dollars of which about 27 million dollars will be needed to replace the water and sewer pipes. 1 9/8/86 /pm Tape 2 Tape 3 Vicki Beech, resident of Section 20, noted that the problems are that these projects were not done properly in the beginning. Jack Rose noted that the actual figures should be available tonight. Henry Roth, resident, noted that in past years there was a surplus fund accumulated in the approximate amount of 2 million dollars. He said at that time it was used to keep the tax rates low and he questioned why a surplus was not planned for the future years. V/M Stelzer noted that monies that are in excess of needed funds that are accumulated in the future will go into a surplus fund. Milt Siegel, resident, said he is proud of the City's Police Department and he noted that the Police Chief is requesting nine additional officers be added to the staff and he questioned if they are needed. Mayor Hart said he believes the addition is necessary since the Police Chief has stated that these men are needed to give 24 hour protection to the City. C/M Stein noted that the total area of Tamarac must be considered and not just the population involved. Mr. Siegel said the BSO will not accept anyone on compensation and he questioned how Police on compensation now will get paid if the City goes with BSO. Mayor Hart said the present budget includes all operational expenses of the Police Department as they presently are and every phase of the BSO contract will be studied. Mr. Siegel asked what has happened to the sum of 5 million dollars which was recovered from ESM and V/M Stelzer said that amount is not considered budgeted income and the interest is not budgeted. Zeke Feldman, 6716 NW 60 St., Tamarac, said last year the Police Department requested 6 new cars and did not receive them; however, they are requesting them again at approximately $13,000.00 per car for a total of $200,000.00. He said he is in favor of this. Sherman Nerle, 9415 NW 81 St., Tamarac, asked why a 15% raise is projected for the Police and Fire and the Finance Director said the State does not reimburse the City and monies must be obtained from ad valorem taxes. Larry Schneider, 6095 Sabal Palm Blvd., Tamarac, suggested adding a tax to the utilities to reduce the ad valorem. Mayor Hart noted that almost every City does have a utility tax. Jeanette Crain, 7208 NW 64 St., Tamarac, said people who go away can afford this tax more than people who live here all year long. Louis Silverman, 6704 NW 74 Place, Tamarac, noted that people who bring newspaper to the dumpsters provided are paid $1.25 per 100 pounds and the City will save $6.50 on the sanitation company's charge to the City. Larry Schneider, resident, asked if Council has considered bring- ing more business into the City and Mayor Hart noted that this would not affect the present budget. Florence Bochenek, 9910 NW 70 St., Tamarac, suggested charging each resident on the utility bill for the exact amount Waste Management charges the City for garbage collection. Mayor Hart closed the public hearing with no further response. V/M Stelzer said the budget for the Police Department for FY 85/86 was 3.3 million dollars and this year is 3.945. He said salaries for the Police Department are $413,000.00 and for the Fire Depart- ment, the salaries are $70,000.00. 1 2 / 9/8/86 /pm F1 V/M Stelzer said there is an additional amount of $82,000.00 for the Insurance for Police bringing the total to approximately $600,000.00 for increases that cannot be changed. Mayor Hart noted that there were Council Budget Workshop meetings during which the budgets were discussed for each department and these figures were available to every member of the public who attended the meetings. Mayor Hart asked for a show of hands of the public present as to whether they would rather have the 4.58 millage as property tax, which would include utilities or have the 3.35 millage rate with a separate 6% utility tax. The majority of those present were in favor of the latter choice. V/M Stelzer noted for the public that when the budget is prepared the Finance Department knows what the income and expenses will be for the coming year and the difference between those two figures is the ad valorem tax. He said the City needs $4,092,000.00 as income whether it is all from ad valorem tax or is broken into a combination of ad valorem tax and a 6% utility tax. C/M Stein asked the people present who live in condominiums what their average electric bill is and several people present, by show of hands, indicated that their bills were less than $100.00. He said it costs the City approximately $7.00 per month for collec- tion of garbage for each person, totalling $84.00 per year. He said 6% of an amount under $100.00 is only $60.00 and, in most cases, would total only about $40.00 to $50.00. He said that is why the utility tax is more equitable than paying for garbage collection. C/W Massaro said for a single family home it costs the City $72.24 for garbage collection and the break even point is the $75,000.00 assessment less $25,000.00 exemption. She said in a condominium it costs $68.16 to collect the garbage based on a $72,000.00 assessment less the $25400.00 exemption. She said if a home is assessed for more than that, someone is being subsidized and, if a home is assessed for less than that, the homeowner is not paying their fair share. C/W Massaro said for a $100,000.00 home, the City pays $72.24 to collect the garbage and the homeowner is paying $127.00 per year for garbage collection; therefore, they are subsidizing people. C/W Massaro said commercial accounts pay for their own garbage collection, yet they pay $1.45 per $1,000.00 of assessment; therefore, they are paying double. She said rental property is in the same situation since they must pay for their own garbage collection, an Occupational License and they must pay $1.45 per $1,000.00 for assessment of their property. She said this is double taxation. She said she does not feel a City should do business this way and it should be equitable and fair. * * V/M Stelzer MOVED APPROVAL of Tem eso. #4250, setting the * millage rate at 3.35 with a 6% utility tax, SECONDED by * C/M Stein. C/W Massaro said something that is unfair should be corrected this year. C/M Stein said last year, when the $3.00 garbage tax was imposed, the people rebelled and he agreed with C/W Massaro that the only way to handle this would be to have direct bills from the garbage collection people to the residents. He said that way, if the residents do not want their garbage collected, they can do whatever they want. He said it costs the City 1.3 million dollars to collect garbage and he felt this would be the fairest way to collect the monies needed. 9/8/86 /pm C/M Gottesman read from a Tam -A -Gram of last year, which stated that in 1985/86, Tamarac had a $36.00 per year (average) per unit owner; approxi mately $3.00 per month. He read: Coconut Creek - $ 85.00 Cooper City - $102.00 Coral Springs - $102.00 Davie - $ 97.00 Lauderdale Lakes- $ 63.00 He said Council should pass a Resolution which states that resi- dents will pay their share of garbage collection, whatever that amount might be. V/M Stelzer said presently $1,300,000.00 is now budgeted for garbage collection, which is the equivalent of 1.46 in ad valorem taxes. He said with the exemption, a home assessed at $60,000.00 would pay $58.40 in ad valorem taxes. He said a home assessed at $300,000.00 would pay approximately $402.00 for garbage collec- tion. Mayor Hart noted that he will call a Budget Workshop before the second reading of this Ordinance. C/W Massaro asked what "utility tax" means and V/M Stelzer said telephone and electric but does not include garbage. Ord. #1286 - To adopt the Annual Tamarac Utilities West Fund Budget for FY 1986/87. First Reading. SYNOPaIS OF ACTION: APPROVED on first reading and public hearing was held. C/M Gottesman said he would like an explanation of how this grew to this size and the Finance Director said salaries grew in the Utilities West Department this year, Debt Service rose 1 million dollars this year and there were some projects that totalled about $400,000.00.
