LL, LTD.,FOR THE VTSUAL GRAPHICS PROJECT, AND PROVIDING AN EFFECTTVE DATE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORTDA: SECT]ON 1: That the Safety Ingress/Egress easement offered by Fundamental Hopkins - Easton No. L]-, Ltd., for the visual Graphics project is HEREBY APPROVED AND ACCEPTED, a copy of said easement being attached hereto as t'Exhibit 1u. SECTION 2:That the appropriate City officials are hereby authorized to execute said easement on behatf of the Ci ty. SECT]ON 3:That. the City Clerk is hereby authorized and in the public records ofdirected to record said easement Broward County, Florida. NO ABRAMOWTTZ MAYOR RECORD OF COUNCILYOTE CITY A MAYOR DISTRICT I: DISTRICT 2: DISTRICT 3: DISTRICT 4: ,,€./H.I" (-gq-Al\ SAFETY INGRESS AND EGRESS EASEMENT This Safety Ingress and Egress Easement made tnis 1* day of March, 1988, by FUNDAMENTAL HOPKINS-EASTON NO. ll, LTD., a Florida Limited Partnership, the ffGrantor'r, whose address is 300 Greco Avenue, Coral Gables, Florida 33146, and the CITY OF TAMARAC, a Florida municipal corporation, the "Grantee", whose address is 5Ell N.W. 88th Avenue, Tamarac, Florida. (Whenever used herein, the terms "Grantor" and "Grantee" shall include the respective legal representatives, successors and assigns of the Parties hereto, whenever the context so admits or requires). VITNESSETH: WHEREAS, Grantor is the owner of that certain real property located in Tamarac, Broward County, Florida, known as Parcel rrArr of V,G.C. PARK, according to the Plat thereof, recorded in Plat Book 109, at Page 7, in the Public Records of Broward County, and desires to give and grant the Grantee a safety ingress and egress easement over said Property aforedescribed, and the Parties are desirous of reducing their understandings and atreement to writing. NOW, THEREFORE, in consideration of the sum of TEN AND NO/100 (510.00) DOLLARS, and other good and valuable considerations paid by each of the Parties hereto to the other Party, receipt of which is hereby acknowledged by both Parties, the Parties l-rereto ilc l-rercby warrant and agree as follows: l. Grantor hereby gives and grants to Grantee, its successors and assigns, a safety ingress and egress easement (the "Easement") over and upon the following Property owned by Grantor, to wit: Parcel rrArr of V.G.C. PARK, according to the Plat thereof, recorded in Plat Book 109, at Page 7, in the Public Records of Broward County, Florida; for the purpose of permitting the Grantee ingress and egress to and from, and over, the above Property in order that it may provide municipal services including but not limited to utility services, canal maintenance, fire protection, police protection and other public safety services in the event of any emergencies. To the fullest extent possible, the access to the Property for the aforesaid purposes will be used by Grantee over normal driveway entrances and exits now or hereafter provided within the Property. 2. Grantee understands that that Grantor or its successors in ownership of the above Property intend now or hereafter to construct building or buildings or other improvements upon the Property, in addition to an existing building which is now situate upon a portion of the Property, and nothing contained herein shall be deemed to, or operate to, prohibit or restrict such activities, subject to compliance with other regular requirements of the Grantee relating to such construction and the regular requirements relating thereto of any other governmental authority having jurisdiction, and at all times and upon the construction of any additional building or buildings or other improvements upon the Property, the rights hereunder in favor of the Grantee will be exercised so as to minimize any interference with, and to be compatible with, the construction and use of all such building or buildings and improvements. The purpose hereof is simply to confirm the safety ingress/egress rights of the Grantee for the purpose aforesaid, and nothing hereby imposes any limitation or restriction upon the construction of any building or buildinSs a1} improvements, or other lawful use of the Property by the Grantor, and the existence of this Easement does not impose in and of itself any limitation upon the location of any future building or buildings or other improvements. 1. This Safety Ingress and Egress Easement shall be binding upon the Parties hereto and their respective legal representatives, successors and assigns, and shall be and constitute a covenant running with the land. 4. This Easement may only be released or modified with the express written consent of the Grantee, and should the Easement no longer be necessary for safety ingress and egress purposes, in the sole judgment of the Grantee, then the Grantee will quit claim its rights hereunder unto the Grantor.
