CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-89 - A;3
A RESOLUTION ISSUING DEVELOPMENT ORDER NO.234-L FOR V.G.C. PARK REPLAT PURSUANT TO
THE PROVISIONS OF SECTIONS 7.2 THROUGH7-tl OF THE TAMARAC CITY CODEr AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City
Council of Tamarac, Florida, a public meeting has been adver-
tised in accordance with applicable law of the date, Eime and
place of the meeting regarding the review of the application
for a revised development order by the applicant for
development approval; and
WHEREAS, the City Council has examined and investi-
gated the apptication, staff and Planning Commission re-
commendations, and the attached Development Review Status
Sheet dated September 13, L989; and
WHEREAS, the City Council reviewed the revised
development order and accompanying documents at a public
meeting; and
WHEREAS, the City Council has determined that the
application is in compliance with all elements of the Compre-
hensive P1an, or will be in compliance prior to the issuance
of a Certificate of Occupancy for the development that is the
subject of the application.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE C]TY OF
TAMARAC, FLORIDA:
SECTION 1: That the development described on the
attached Development Review Status Sheet dated September L3,
1989, is granted a revised development order to proceed
subject to the following conditionss
A. Construction is to be in complete compliance with
the plans and specifications submitted by the developer to
the City of Tamarac as described in Section II of the
Development Review Status Sheet and approved engineering
drawings.

B. The revised development order is assignable, but
an assignment does not discharge any assignee from strict
compliance with the order unless the City Council consents to
modify any of the original requirements.
C. Additional conditions established in order to
issue the revised development order are set forth as follows:
Subject to the City receiving a Water Retention
Agreement, a Letter of Credit in the approximate
amount of 556,000.00 and Drainage Improvement Feesin the approximate amount of $4,000.00 by Friday,
September 29, 1989.
SECTION 2: That the following document is hereby
accepted and approved as
order:
a part of this revised development
Partial Subordination of Encumbrance toProperty Rights
SECTION 3:Should any section or provision of this
revised development order be declared by a court of competent
jurisdiction to be invalid, the City Council sha11 determine
if the other portions of the order remain valid or whether
the approval sha11 be null and void.
SECTION 4:This revised development order as condi-
tioned shall become effective immediately upon its passage.
