A RESOLUTION OF THE CITY OF TAMARAC GRANT-
I NG APPROVAL FOR THE USE OF BROOKWOOD PLAZA
FOR A CRAFT FAIR TO BE SPONSORED BY KIT N'KABOODLE, 7160 WEST MCNAB ROAD, FROM OCTOBER28TH THROUGH OCTOBER 29, 1989, PROVTDINGTHAT SUCH APPROVAL IS CONTINGENT UPON THEEXECUTION OF A HOLD HARMLESS AGREEMENT; ANDPROVIDING FOR AN EFFECT I VE DATE.
WHEREAS, the Clty of Tamarac has recelved
Klt N' Kaboodte to sponsor a Craft Falr on
through October 2gth, 19gg at Brookwood plaza,
on Exh I b I t trA,, at tached hereto ; and
a request from
October 28th

WHEREAS, Krt N' Kaboodre wrshes to sponsor a craft Farr
to beneflt Krds rn Drstress and wr rd Anrmar care, non-profrt
organ I zat lons; and
WHEREAS, Krt N' Kaboodre has agreed to hord the crty
harmless of any crarms whatsoever arlslng from the tocatron,
construct lon, I nsta I I at lon and operat lon of a craft Fa I r at
Brookwood plaza.

NOW, THEREFORE,
CITY OF TAMARAC,
BE IT RESOLVED BY THE CITY COUNCIL OF
FLOR I DA:
SECT I ON That the grant I ng of the approva ' for the
locatlon of a craft Farr at Brookwood praza rs subject to an
executed Hord Harmress Agreement between the city, Ktt N,
Kaboodle and Brookwood plaza.
SECTION 2 :That the granttng of Ctty approval for the
locatlon of a craft Farr at Brookwood praza rs not rntended
to walve the requrrement that Krt N, Kaboodre obtarn ar r
approprrate permrts and pay art approprrate rrcense and
perm I t fees.
SECT ION 3 That Klt N' Kaboodte agrees that access to
Its craft Farr srte shail be ilmrted to the Brookwood piaza
entrances and exlts and that such access and lnternal trafflc
flow shalr be consrstent wtth the pran attached here to as
exh lb lt "A".

October 28th through October 29th, 1989.
SECT ION 5 :That proper I nsurance coverage be prov I ded
to the Clty ln connectlon wlth the operatlon of the Craft
Falr.
SECTION 6 : That Klt N' Kaboodle agrees to I lmlt the
Craft Falr tables to thlrty (30) partlclpants and sald tables
shall not block the entrances./exlts of the subJect premlses
or that of adJacent buslnesses.

HOLD HARMLESS AGREEMENT g-gq-eel

t FThis agreement entered into on the / C day of
, l-9B9 is made by and between the City of
Tamarac, a municipal corporation, hereinafter, "CfTy" and
Kit N' Kaboodle, the sponsor, hereinafter, "KIT N' KABOODLE",
and Brookwood Plaza, hereinafter, "BROOKWOOD PLAZA".
WHEREAS, KIT Nr KABOODLE wishes to sponsor a Craft Fair
on Saturday, October 28th and Sunday, October 29Lln, L9B9 to
benefit Kids in oistress and wild Animal- care, non-profit
organi-zations and other worthy causes; and
WHEREAS, KIT Nr KABOODLE wishes to stage the Craft Fair
on a portion of the Brookwood pl-aza, ofl Saturday, October
28Lh, and Sunday, Ocuober 29, 1989, starting at 10:00 A.M. to
4:00 P.M.; and
WHEREAS, the city council- of the city of Tamarac has
determined that the execution of this Hold Harmless Agreement
is in the public interest.
NOW, THEREFORE, in consideration of the sum of one
doIlar ($1 .001 and other good and val-uabl-e consideration
received from Krr N'i KABooDLE and in consideration of the
mutual- covenants ccntained herein, the parties agree as
fol-]ows:
SECTION I That KIT Nr KABOODLE shal_l_ indemnify,
hold the crrY harml-ess and defend the crry from any and all_
claims, cauSes of actj-on, damages, costs, expenses and
attorney fees which the crry shal-I suffer by virture of the
defense of, or response to, any claim being made against it
in connection with the craft Falr sponsored by Krr N'
KABOODLE, its agents, employees, members, participating busi-
nesses, oy the general public 1n connection therewith.
SECTION 2 The above provisions shal-l- survj-ve the
termination of this Agreement and shal-l- pertaln to any
occurrence during the term of this Agreement, even though the
claim may be made after the termir:ation hereof .
WITNESSETH:

SECTION 3 :KIT Nr KABOODLE shal-l- keep such policies
of insurance in ful-I force and effect during the term of this
Agreement and shall provide to the CITY proof of payment of
the required premiums.
SECTTON 4 :KIT N' KABOODLE shall- provide the CITY
with the reguisite document evidenci-ng that the signatory for
KIT Nr KABOODLE has the authority to enter into this agree-
ment.
IN WITNESS WHEREOF, the parties have hereunto set their
hands and seals on the day and year first above written.
