RESOLUTION NO. R-89 - Sbg
A RESOLUTION ISSUING DEVELOPMENT ORDER
NO.25B FOR MELAUR MEDICAL PLAZA FOR APLAT PURSUANT TO THE PROVISIONS OF
SECTIONS 7-2 THROUGH 7_1.L OF THE TAMARAC
CODE, AIID PROVIDfNG AN EFFECTM plrE_.- -
WHEREAS, pursuant to the inst.ructions of the City Council of
Tamarac, Florida, a public meeting has been advertised in accordance
with applicable law of the date, time and place of the meeting
regarding the review of the appl-ication for a development order by
the applicant for development approvali and
WHEREAS, the City Council has examined and investigate the
application, staff and Planning Commission recommendations, and the
attached Development Review Status Sheet dated September L4, L9B9t
and
WHEREAS, the City Council reviewed the development order and
accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the application
is in compliance with all elements of the Comprehensive Plan, or
will be in compliance prior to the issuance of a Certificate of
Occupancy for the development that is the subject of the applica-
tion.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1:That the development described on the attached
Development Review Status Sheet dated September L4, 1989, is granted
a development order to proceed subject to the following conditions:
A. Construction is to be in complete compliance with the plans
and specifications submitted by t.he developer to the City of Tamarac
as described in Section II of the Development Review Status Sheet
and approved engineering drawings

B. The development order is assignable, but an assignment does
not discharge any assignee from strict compliance with the order
unless Ehe City Council consents to modify any of Ehe original
requirements.
C. Additional conditions established in order to issue the
development order are set forth as follows:

SECTION 2: That the following documents are hereby accepted
and approved as a parL of this development order:
1. Blanket Public Safety Ingress/Egress Easement
2. ParEial Subordination of Encumbrance to Property Rights
3. Water Retention Agreement
SECTION 3: Should any section or provision of this develop-
ment order be declared by a court of competent jurisdiction to be
invalid, the City Council shall determine if the other portions of
the order remain valid or whether the approval shall be null and
void.
SECTION 4:This development order as conditioned shall become
effective immediately upon its passage.
